Apexintensity Affiliate Program Terms and Conditions

**1. Agreement**

By signing up to be an Affiliate of Apexintensity, you are agreeing to be bound by the following terms and conditions.

**2. Joining the Program**

By filling out the signup form, and upon its acceptance, you will become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website and products and receive a commission on products sold to individuals referred by your own website or personal referrals.

**3. Revocation of Affiliate Status**

Apexintensity reserves the right to reject or remove any affiliate from the program at its discretion.

**4. Affiliate Responsibilities**

It is understood that affiliates will use only ethical marketing methods to promote Apexintensity and its products. Any deceptive tactics, such as the use of spam, false advertising, or misleading links are grounds for removal from the affiliate program and will result in the forfeiture of all earned commissions.

**5. Liability**

Apexintensity will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or our website. We do not make any expressed or implied warranties with respect to the Program and/or products sold by Apexintensity. We make no claim that the operation of the Program and/or our website will be error-free and we will not be liable for any interruptions or errors.

**6. Term of the Agreements**

The term of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. Upon the termination of this Agreement for any reason, all licenses granted hereunder shall immediately terminate and you will immediately cease the use of, and remove from your site, all links to our site, and all Apexintensity trademarks and logos, other Apexintensity marks and all other materials provided in connection with this program.

**7. Governing Law**

This Agreement is governed by the laws of the [Country/State], without reference to rules governing the choice of laws. Any action relating to this Agreement must be brought in [Your Location's courts], and you irrevocably consent to the jurisdiction of such courts.

**8. Indemnification**

Affiliates agree to indemnify, defend, and hold harmless Apexintensity from any and all liability, loss, damage, claim, or expense, including reasonable attorney's fees, arising out of or related to any noncompliance by the affiliate with the terms and conditions herein, or any wrongful or negligent conduct committed by the affiliate.

**9. Modification**

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but are not limited to changes in the scope of available referral fees, fee schedules, payment procedures, and Affiliate Program rules.
