Genetic Labs Australia Affiliate Program – Terms & Conditions

These Terms & Conditions govern your participation in the Genetic Labs Australia Affiliate Program (“Program”). By joining, you agree to comply with all conditions listed below.

⚠Zero Tolerance Policy: Any breach of these Terms — including brand bidding, use of Google Ads, coupon violations, or misrepresentation of our brand — will result in immediate termination and forfeiture of all pending commissions. No warnings, no second chances.

1. Commission Terms

• Affiliates receive 20% commission on eligible sales.

• Commissions are paid at the end of each calendar month, in AUD.

• Commission is based on the final transaction amount, excluding shipping, taxes, discounts, returns, or chargebacks.

• Fraudulent, self-referral, or suspicious transactions will be voided with no commission payable.

2. Strict Prohibitions

2.1 Trademark Protection

• You may not bid on our brand name “Genetic Labs Australia” or any variation or misspelling thereof (e.g., "Genetic Lab Supplements", “GeneticLabsAustralia”, “GeneticLabsAU”) in any form of paid advertising, including Google Ads, Bing Ads, Meta Ads, etc.

• Bidding on our brand or trademarks will result in immediate termination from the Program and forfeiture of all pending commissions.

• You may not impersonate or misrepresent Genetic Labs Australia in your content, ads, or communications.

• You may not use our trademarks, logos, or domain names in your ad display URL, page titles, or social handles.

2.2 Advertising Restrictions

• Google Ads are strictly forbidden for use in promoting Genetic Labs Australia.

• No paid search traffic is allowed that targets our brand name or related keywords.

• No direct linking to our website from paid ads. All traffic must be routed through your own original content or landing page.

• No pretending to be Genetic Labs Australia — you may not present yourself as the brand in any ad or organic content. We are a trademarked company and will actively enforce misuse.

2.3 Coupon Site Restrictions

• Coupon or deal sites are not permitted to add, list, or promote Genetic Labs Australia coupons or discount codes.

• Affiliates may not upload, share, or republish other affiliates’ coupons on coupon/deal websites.

• Any violation of this rule will result in immediate termination and commission forfeiture.

3. Brand Representation

• Affiliates must uphold the brand integrity of Genetic Labs Australia.

• No misleading, false, or exaggerated claims about our products or results are permitted.

• You may not create websites, domains, or social pages that appear to be official representations of our company.

4. Termination Rights

We reserve the right to terminate, suspend, or withhold commissions from any affiliate at any time, with or without cause, and especially in the event of:

• Trademark violations

• Paid ads abuse (including Google Ads and brand bidding)

• Misleading conduct or impersonation

• Low-quality traffic or suspected fraud

• Coupon site violations

Decisions are final and non-negotiable. Continued promotion after termination may result in legal action.

5. Affiliate Monitoring

Your activity may be monitored at any time to ensure compliance.

We use third-party tools and manual audits to detect:

• Ad bidding violations

• Domain spoofing

• Brand impersonation

• Coupon misuse

6. Legal Action & Liability

Violation of these Terms may result in:

• Immediate termination from the Program

• Withholding of commissions

• Legal action for damages or injunctive relief

You agree to indemnify and hold harmless Genetic Labs Australia from any claims arising from your breach of these Terms.

7. Changes to Terms

We reserve the right to modify these Terms at any time.

Continued participation in the Program after updates constitutes your acceptance.

By joining the Affiliate program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote app by Children

UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through sales@geneticlabsaustralia.com. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
