Latitude Board Affiliate Program Terms and Conditions

Welcome to Latitude Board! Thank you for joining our Affiliate Program. These terms and conditions apply to individuals using the Program as both a merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to our products or services.

By participating in the Program, you agree to use it as specified in these Terms and Conditions. If you do not agree with these Terms and Conditions, you are not authorized to register as an Affiliate or participate in the Program in any manner.

1. Approval or Rejection of Registration

We reserve the right to approve or reject any Affiliate Program registration at our sole discretion. You have no legal recourse against us if your registration is rejected.

2. Affiliate Links and Coupons

An affiliate link is automatically generated for you, but you can also create a link for a specific product or collection. If someone clicks on another affiliate's referral link and then later clicks on yours, your link will be credited.

You might be assigned a coupon code, detailed on your Dashboard. If a customer uses both your affiliate link and your coupon code, you will not receive a double commission. If you are not assigned a branded coupon, you cannot promote the coupon.

Affiliates may advertise the merchant's website through online channels such as Facebook and Instagram, or offline channels like classified ads, magazines, and newspapers. Affiliates must own the site, blog, or email marketing site used for promotion and may not promote on affiliate aggregation sites like Coupon Cabin or RetailMeNot, etc.

3. Commissions and Payment

When you refer a customer who makes a purchase on our website, you will receive a commission based on our commission structure after the return window of 35 days has closed. The commission is calculated based on the order value minus any promotional or bundle discounts and excluding extra fees (tax, shipping, etc.).

To receive a commission, specify your payment details in Settings. Payment schedules will be notified on the Affiliate Guide page.

Payments are only sent for successfully completed transactions (after the 35-day return window). The use of the Affiliate Program is subject to a fair use policy, allowing the merchant to review each referral order. The status of commissions is displayed in the Commission tab, and any paid commission will be listed in the Payment tab. Transactions that result in chargebacks or refunds will not be paid out.

Affiliates are not considered employees of First Wave Productions/ LatitudeBoard.com. Affiliates are responsible for documenting and reporting federal and state income. Any fees assessed on Venmo transfers are the affiliate's responsibility.

4. Marketing Tools

We may share promotional media such as banners, logos, or specific collection promotions with you through the Marketing tool tab. You can download the media or get the HTML embed code to share on affiliate channels.

5. Cookie Usage

We use cookies to track people who click on your link. If a person does not allow cookies or clears their cookies, we cannot track them and cannot pay earnings on their activity.

The cookie duration is specified on the Affiliate registration form. Tracking begins when a customer clicks on your link or uses your coupon. Within this period, any order made by this customer on the merchant website will automatically result in commissions to the affiliate. There is no need for the customer to click on the affiliate link each time.

6. Removal from Referral Program

If an affiliate wishes to be removed from the affiliate program, they can do so by contacting: TheBigCheese@latitudeboard.com.

7. Product Claims

Please familiarize yourself with our products and FAQs. Affiliates making false claims about our products may be immediately terminated from the program. Integrity is important to us.

This Privacy Policy of UpPromote about Affiliate Marketing system describes how we may collect and use personal data and the rights granted to merchants, affiliates and customers regarding their respective data.

By joining the Affiliate program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote app by Children

UpPromote is not intended for children. If you are under 18, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through TheBigCheese@latitudeboard.com. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
