Legendary Legion Affiliate Terms and Conditions
Welcome to Legendary Supplements! Thanks for joining our Legendary Legion affiliate program (“Program”). These Terms and Conditions will govern the relationship between Legendary Supplements (“we” or “Legendary”) and you (“you” or “Affiliate”).
By participating in the Program, you agree to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an Affiliate or participate in the Program in any manner.
Your role as an Affiliate will be to promote Legendary's products using affiliate links and codes that you share on your websites and social media accounts at all times in compliance with all applicable laws and regulations including guidelines issued by the United States Food and Drug Administration and the Federal Trade Commission.
- Approval or Rejection of Your Affiliate Program Registration
We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against Legendary if your Affiliate Program Registration is rejected, terminated, or canceled.
- Affiliate Referral Links and Coupon Codes
Your affiliate referral link will be automatically generated, but you can also generate an affiliate link for a specific product or collection. If a customer clicks on another Affiliate’s referral link and later clicks on your affiliate referral, your referral link will be the only link recognized when calculating and paying commissions as outlined in Section 3.
You may or may not be assigned to one coupon code with details and usage clarified on the UpPromote Dashboard. If a customer attempts to use both the affiliate link and coupon code, you will not receive a double commission. If you’re not assigned a branded coupon, then you’re not allowed to promote the coupon.
You may also advertise merchant websites on online channels such as Facebook, Instagram, etc. or offline classified channel ads, magazines, and newspapers.
- Your Promotion of Legendary Products
In all content that you create to promote Legendary products, you shall:
- Positively promote and endorse Legendary’s products, services, and brand.
- Accurately and honestly represent Legendary’s' products based on your experience and subject to Legendary 's marketing claims and guidelines.
- Act professionally and positively when promoting Legendary’s products, to maintain the highest ethical standards and to avoid even the appearance of impropriety.
- Create content that is in good taste and free of profane or inappropriate language and/or any content promoting bigotry, racism, or discrimination based on race, gender, religion, national origin, disability, sexual orientation, physical disability, or age.
- Avoid sites that promote in any way (i) sexually explicit material or violence; (ii) discrimination based on race, gender, religion, national origin, sexual orientation, physical disability or age: (iii) illegal activities; and (iv) hate speech or hate of any kind.
- Avoid the use of political or religious statements, themes, or concepts when promoting Legendary products.
- Ensure that the content is appropriate for all age groups.
- Avoid adult themes, images, statements, or concepts.
- Avoid the depiction of drugs, drug usage, or drug paraphernalia in all content.
- Comply with FTC Guidelines and Laws. You shall clearly and conspicuously disclose your relationship with Legendary in all promotional activities and identify yourself as a brand ambassador of Legendary. You shall make only truthful, honest, and non-deceptive representations about your experience with Legendary’s Poducts and shall not make any false claims. You shall comply with all applicable laws and regulations including the Federal Trade Commission Guidelines for the Use of Endorsements and Testimonials in Advertising. All required legal disclaimers shall be included in any promotional materials or activities as required by law.
- Comply with FDA Guidelines and Laws for Dietary Supplements. You shall not directly or impliedly state that Legendary Products are intended to diagnose, treat, cure, or prevent any disease. Additionally, you shall not directly or impliedly state that the claims and benefits of Legendary Products have been evaluated by the Food and Drug Administration or that the Products are intended to diagnose, treat, cure, or prevent any disease.
- Commissions and Payment
When a customer you have referred to make a purchase on Legendary’s website and the transaction has been successfully completed, Legendary will pay you a commission as follows:
a. First Time Customer Orders: ten percent (10%) of the retail order value excluding extra fees such as sales tax, use tax, and shipping and handling charges received by Legendary for qualifying sales.
b. Repeat Customer Orders: five percent (10%) of the retail order value excluding extra fees such as sales tax, use tax, and shipping and handling charges received by Legendary for qualifying sales.
Before you receive any commission, you need to specify the payment details on the Settings in your UpPromote profile. Payment schedule will be notified on the UpPromote Affiliate Guide page. Legendary shall pay commissions to you on a monthly basis within thirty (30) days of the end of the month in which the qualifying sales were made. Legendary will release commission payments to you when you have earned a minimum of $25 USD
Your use of the Affiliate Program is subject to a fair use policy which gives Legendary the right to review each and every referral order. You can review the status of a commission in your UpPromote Commission tab. All paid commissions will be listed in your UpPromote Payment tab. Legendary reserves the right to adjust or deduct from future commission payments any amounts refunded to customers if such amounts have already been paid to you as commission. Transactions that result in chargebacks or refunds will not be paid out.
You will be solely responsible for paying any applicable taxes on the compensation that you receive from Legendary.
- Marketing and Promotional Tools and Resources
We may share with media such as banners, logos, images, copy, prompts, or specific collection promotional materials (“Promotional Media”) to you through the Marketing tool tab. You can download the Marketing Media or obtain the HTML embed code in order to share on affiliate channels.
- Referral of Others to Participate in Program
We encourage you to invite other individuals to participate in the Program. You may share a network link with any other individual who is interested in becoming an Affiliate. Legendary will pay you a referral fee–in the form of payment to be determined by Legendary but including cash, swag, complementary product, etc.–for any individual who you referred and is approved to participate in the Program.
- Cookies
We use a cookie to track customers who click on your referral link. To qualify you for commissions, the customer needs to be using cookies for Legendary to properly track transactions associated with your referral link..
If a customer does not allow cookies or clears their cookies, Legendary cannot track and associate transactions with your referral link, and you will not receive commissions for those sales.
Cookies tracking day is provided in the Affiliate registration form. The cookies tracking day will start from the time a customer clicks on your referral link or uses your coupon. Within the cookie time, every transaction completed by a customer on Legendary’s website will automatically result in commissions being paid to you. The customer does not need to click on the affiliate link each time as long as the customer’s use of the Legendary website is within the same cookies tracking day.
- Intellectual Property
Legendary is the sole and exclusive owner of all right, title, and interest in the Promotional Media. Legendary , including all intellectual property rights therein. Except for the limited rights and licenses expressly granted to you to use the Promotional Media to create content that you share, Legendary reserves all rights, title, and interest (including all intellectual property rights) in and to the Promotional Media. No rights are granted to you hereunder other than as expressly set forth herein.
You agree to grant Legendary the right to repost or share the content you create using Promotional Media.
- Your Relationship with Legendary
You are retained as an independent contractor of Legendary. You acknowledge and agree that (i) you are solely responsible for the manner and form by which you perform under this Agreement, and (ii) you are a self-employed individual. You are responsible for the withholding and payment of all taxes and other assessments arising out of your performance of services, and you are not entitled to participate in any employee benefit plans of Legendary.
- Termination or Cancellation of Your Participation in Program
Legendary reserves the right to cancel or terminate your participation in the Program at any time and in its sole discretion. If an affiliate wishes to be removed from the affiliate program, they can do so by contacting: support@legendarysupps.com.
- Miscellaneous
Waiver: The failure of Legendary or you to enforce any right or remedy under these Terms and Conditions shall not constitute a waiver of such right or remedy unless acknowledged and agreed to in writing by the other waiving such right or remedy.
Dispute Resolution: In the event of a dispute arising out of or relating to these Terms and Conditions, you and Legendary agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations, you and Legendary agree to binding arbitration in Utah before a single arbitrator in accordance with the then-current commercial arbitration rules of the American Arbitration Association.
Changes: We may, at any time and from time to time, revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then-current Terms and Conditions.
