Terms

These following terms and conditions apply to individuals who are accessing or using the Program both as TinyHorse (“we” or “company”) who provides the products and an ambassador (“you” or “ambassador”) who refers potential customers to use products from TinyHorse.

By participating in the Program, Ambassador agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Ambassador or participate in the Program in any manner.

1.  Approve or Reject of the Registration

We reserve the right to approve or reject ANY TinyHorse Ambassador Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your TinyHorse Ambassador Program Application.

2. Ambassador Links and Coupon

Ambassador link is automatically generated and customizable after acceptance into the Program. You can also generate an ambassador link for a specific product or collection or to create a unique link to track the performance of a specific link. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.

The details and usage of the coupon code assigned to Ambassador is clarified on the Dashboard. If a customer clicks on both on your ambassador link and uses your coupon code at check out, you will not receive a double commission.

Ambassador may advertise the TinyHorse website (walkmultipledogs.com) on online channels such as Facebook, Instagram, etc, as well as offline such as through print materials, magazines, and newspapers.

If the referring customer fails to use an Ambassador code/link during their checkout process, we are unable to retroactively assign a referral to an ambassador or to refund the missed discount to the referred customer. 

Ambassador coupons cannot be combined with any other promotional offer unless otherwise stated.

3. Commissions and payment

Refer any customer to make a purchase on our website, you will get a commission amount dependent on our current dynamic flat fee rate. Commission amount is calculated after discounts and excludes any fees collected for tax, shipping or duties.

In Tier 1, every successful referral receives 8% of the average order value (AOV) generated from this program in the previous month in the form of Store Credit.

For example, if the AOV for the program in March was $150 (CAD), then the flat rate fee will be $12.00 (CAD) per referral for all of April. And if you succeed in producing 10 referrals in April, you’ll get a $120 benefit in Store Credit.

We’re calling this the Dynamic Flat Rate (DFR). The DFR will be updated on the first day of each month.

Store credit commissions are paid out quarterly, though the timeline may be negotiated on a case-by-case basis.

In Tier 2, you will receive 7% cash commission on the order value for each successful referral. The "order value" is based on the order amount after discounts and excludes fees collected for shipping, taxes and duties. 

Cash commissions are distributed monthly, which is done automatically and cannot be negotiated. To receive your cash commission, you need to specify the Pay Pal details in Settings.

Payments will only be sent for transactions that have been successfully completed. Use of the Ambassador Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission if displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.

4. Marketing tool

Access marketing graphics through the Marketing tool tab. You can download authorized media there to share on Ambassador channels.

If you are removed from the program, you are no longer athorized to distribute content containing materials access through the marketing tool.

5. Cookie

We use a cookie to track people who click on your link, however they need to have cookies enabled for us to track them.

Cookies track for 30 days. The tracking day will start from the time a customer clicks on the ambassador's link or uses the coupon. Within the cookie time, an order made by this customer will automatically result in a commission to the Ambassador. 

If a person doesn't allow cookies or clears their cookies within the 30 days then we can't track them, so can't pay earnings on that person's activity if they don’t use your coupon code at check out. A customer is being tracked by a cookie if the banner appears “You are shopping with {company name}” at the top of the page while they are browsing our online store.

6. Removal from Ambassador Program

Exclusivity

We are directing many resources and sales opportunities towards the Ambassadors to help make the program as successful and as mutually-beneficial as possible. For example, we have removed most discount codes previously offered by the company, so that ambassador codes carry more weight. We consider ourselves advocates for our ambassadors and want to support them in their success, both in referring clients and in the growth of their own pet-care companies. 

We ask our ambassadors to join us in the same spirit by exclusively representing TinyHorse on their website and all social media channels when it comes to equipment for walking multiple dogs. Promotion of any other group walking equipment will lead to your removal from the Ambassador program.

Inactivity

Ambassador accounts will be reviewed quarterly. If an account lacks activity and now referrals are generated for three consecutive quarters, your account will be closed. 

You're welcome to reapply at a later date if applications are open and you deem that you're in a better place to promote your Ambassador code/link.

Spam

Please use discretion when providing your ambassador coupon code or link. We recommend NOT spamming dog walking industry group pages on Facebook or other dog-related community pages and platforms with your ambassador information. Spamming comment sections with your code information is a deterrent for potential referrals, so it harms both the ambassador and the TinyHorse.

If you see an opportunity to refer someone in an online community group we suggest you first ask if they'd like your coupon code or to start a private conversation with them. Remember, you're among your fellow ambassadors and professionals in these groups and your conduct reflects on your own company and, as a TinyHorse Ambassador, ours too. Please be cordial (not competitive) when it comes to providing your ambassador information within your professional circles. 

Do not post your ambassador code directly to TinyHorse content. You can share our content to your own profile/stories and include your code/link on a repost. 

We will periodically share original content created by Ambassors to TinyHorse feed and stories.

Collaborator requests will only be accepted if previously arranged.

Conduct

An ambassador found to be committing or promoting animal abuse (as deemed illegal within their constituency) will be removed from the program.

An ambassador found to be acting coercively or aggressively to generate commissions will be removed from the program. 

An ambassador found to be committing abuse or harassment towards fellow community members may be removed from the program. This harm can be physical, sexual, social, financial, mental or emotional in nature. 

Any abuse of our commission structure or this program will result in the removal of the offending ambassador from the program.

An ambassador found to be slandering TinyHorse staff, products or company methods will be considered for removal from the program. If you have grievances with our products or procedures, please contact us immediately. We are always open to feedback and conversation about our products and activities.

Self-Removal

If an ambassador wishes to be removed from the ambassador program, they can do so by contacting: hello@tinyhorse.ca.

7. Subject to Change

This program is subject to change as a result of experience, new information, changes in technology, and changes to laws regarding affiliate programs and social media platforms. These changes are within the sole discretion of TinyHorse and may be made without prior notice.

In the event that a change effects how commissions are determined, collected and distributed, any commissions collected prior to the change will be honoured under the terms in which they were collected.

This Privacy Policy of UpPromote about Affiliate Marketing system describes how we may collect and use personal data and the rights granted to merchants, affiliates and customers regarding their respective data.

By joining the TinyHorse Ambassador Program for Dog walkers, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our ambassador program after these changes are posted, you agree to the revised policy.

 

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

 

Information collected from Ambassadors

When an Ambassador signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate ambassador background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote app by Children

UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through hello@tinyhorse.ca. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
