Terms and Conditions of Brand Ambassador and Affiliate Agreement – Ancient Choice


A. Brand Ambassador and Affiliate of Ancient Choice must understand and agree to the following instructions:


By sending an application form to marketing@ancientchoice.com, I agree to the terms and conditions listed below:


1. I am 18 years old or older.


2. I am not an agent, franchisee, employee or partner of the company. I cannot act on behalf of the company. I do not have any legal power to incur an obligation, debt or liability on behalf of the company.


3. I confirm that during the application, I have provided correct data about myself. I also confirm that any later adjustments of that information will be correct. 




I will promote and market Ancient Choice products to customers.


Receive samples/products and write about them on social networks (blogs, posts, pictures, videos, etc.).


Share content using the Ancient Choice brand hashtag: #ancientchoice 

As well as other hashtags that fit the brand and content.


I will use received new products for promotions.



4. I will not sell company products on unauthorized websites on the internet or in retail establishments without the written approval of the company.


5. I will protect the company’s name, logo, other trademark or company materials and will not reproduce it in advertising without the written approval of the company.


6. I will promote Ancient Choice products on social media accounts by posting appropriate photos of marketing events showcasing the products. If an objective evaluation of the appropriate pictures is needed, I will contact the company. I will not seek any financial or barter compensation for product promotion through my social media network.


7. I will post as often as I would like on my social media accounts and tag #ancientchoice in each post that relates to the healthy lifestyle and wellbeing. I understand that I have permission to repost an existing post by Ancient Choice.. 


8. I will responsibly behave as required to uphold the reputation of the company. If I do not follow previously mentioned standards, the company will remove me from the Ancient Choice Brand Ambassador and Affiliate Program.


9. If I choose to leave the Brand Ambassador and Affiliate program, Any photos sent to Ancient Choice will remain in their database to use on their social media platforms and marketing campaigns.


10. I must be an active* Brand Ambassador and Affiliate to remain in the program.


11. I agree that the company reserves the right to cancel this agreement at any time.


12. I agree to the company’s privacy policy, and I have read and agreed to these terms.





B. Brand Ambassador and Affiliate program commission:




STANDARD COMMISSION STRUCTURE


The company has established a standard commission of 15% on all Qualifying revenues. The definition of “Qualifying Revenues” indicates the amounts we receive from Qualifying Purchases, excluding returns, shipping, and bad debt.


The commission will be paid for a termless period, i.e. all the time till the new clients place orders with Brand Ambassadors and Affiliate promotional code or affiliate URL.


The company pays the reward for the Brand Ambassador and Affiliate in his/her main selected currency, by transferring the calculated sum to the Account indicated by the Ambassador and Affiliate. 




SPECIAL OFFERS AND PROMOTIONS


The company provides information about ongoing special offers to the Ambassador and Affiliate via personal email message.




C. Ancient Choice (Company) understands and agrees:


1. Company will occasionally provide free products/samples to the Brand Ambassador and Affiliate to promote on social networks.


2. Company will give the Brand Ambassador and Affiliate a 15% Off exclusive promotional code to use for products purchased from Ancient Choice for Ambassadors and Affiliate friends. 


3. If a client submitted an order without a Brand Ambassador and Affiliate promotion code, the company cannot cancel it. Orders, already submitted without Brand Ambassador and Affiliate promotion code, will not be counted to the Ambassador and Affiliate account. The client can apply only one promotion code per order.


4. For better performance regarding customers flow, a company may reward a Brand Ambassador and Affiliate with additional points or barters.


5. If the company decides to terminate the Brand Ambassador and Affiliate program, the company must warn the Brand Ambassadors and Affiliate and provide the notice to all program participants 15 days before the termination date.


6.The Company has all legal right to use any photos sent by Brand Ambassador and Affiliate or shared in social media, which includes the company products or any other notice about the company brand, even if the Brand Ambassador and Affiliate exits the program.


7. The Company agrees with this privacy policy under these terms and conditions.


8. The Company will check the purchases of Brand Ambassador’s and Affiliate friends made with Brand Ambassadors and Affiliate promotional code and orders made with a unique affiliate URL. 




D. General:


1. Either party may terminate this agreement immediately for a cause or without reason upon written notice.


2. Ancient Choice may discontinue the Brand Ambassador and Affiliate Program at any time.


3. The Brand Ambassadors and Affiliate will not be treated as a company employee for any reason.


*active pertains to posting content at least once a week which includes at least one pre-approved Ancient Choice hashtag.

Personal Data means any information relating to you which you yourself have provided. It may be your name, surname, personal ID number, contact information, information relating to agreements you have concluded with Ancient Choice, etc.


Data Subject (you) means a natural person (customer, user, his or her representative) whose personal data we obtain and use further.

This Privacy Policy does not apply to any third-party websites and apps that you may use, including any that are linked to in our Services. We will reply to your Request within a period of not more than 30 (thirty) calendar days since the day of receipt of the Request. In exceptional circumstances, which require additional time, we will, by giving you a relevant notice, have the right to extend the deadline for the submission of the requested data or for the consideration of claims set out in the Request up to 60 (sixty) calendar days after the day of your referral.


We will refuse to satisfy your Request by giving a substantiated response in case any circumstances set out in the GDPR or other legislation are determined upon giving you a relevant written notice.

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.


Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.


Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
