Affiliate Program Terms and Conditions
By filling out the signup form you acknowledge that you have read our affiliate program terms and conditions, understand, and agree with them.
Joining the Program
By filling out the signup form, and upon acceptance, you will become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our websites to receive a commission on products purchased by your referred individuals.
Affiliate Responsibilities
It is understood that you will introduce our products to your current and prospective customers and will comply with all laws as well as those that govern email marketing and anti-spam laws. It is expected that affiliates will create content based on their own personal experiences of Bionic Gym, without making any falsifications and that affiliates would be active users of the product.
By agreeing to these terms and conditions, you agree to the following additional responsibilities:

You will not make any medical claims or suggest that our products can cure, treat, or prevent any medical condition, illness, or disease. Any claims made must be based on the information provided on our website and must be truthful and accurate.

You will not use stock photos to promote our products. Any images used must be original or obtained through legal means.

You will not use lies, exaggeration, false claims, false reviews, false stats, or any other form of deceptive advertising to promote our products. Any claims made must be based on the information provided on our website and must be truthful and accurate.

You will not use brand bidding on any advertising platform to promote our products. This includes bidding on our brand name or any variations thereof.

You must promptly remove any content related to our products if requested to do so by us.
We reserve the right to accept or reject any prospective customers and will pay you a commission per customer referred using your affiliate code according to the designated payment schedule.
Either you or we may terminate the Affiliate relationship at any time. You are only eligible to earn Affiliate payments during your time as an approved Affiliate.
We may change the program or service policies and operating procedures at any time.
Affiliate Relationship
This Affiliate relationship is one of the independent contractors. We will not be liable for indirect, special, or consequential damages arising in connection with this program and our aggregate liability arising with respect to this program will not exceed the total referral fees paid or payable to you.
We make no express or implied warranties or representations with respect to the program. In addition, we make no representation that the operation of the service will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
Revocation of Affiliate Status
Reason for termination of your affiliate application and status in the program may be (but is not limited to) any of the following:

Inappropriate advertisements (False claims, misleading hyperlinks)

Illegal spamming (mass email, mass newsgroup posting, etc.)

Advertising on sites containing/promoting illegal activities

Violation of intellectual property rights

Inability to set up links or refer clients to Bionicgym.com (lack of performance)

Making medical claims or using stock photos, lies, exaggeration, false claims, false reviews, false stats, brand bidding, or any other form of deceptive advertising to promote our products

Failure to promptly remove any content related to our products if requested to do so by us
Affiliate Links
You may use graphic and text links both on your website and in emails. The program may also be advertised "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to our terms & conditions.
If you intend to promote our Program via e-mail campaigns, you must adhere to the following:

Identify the message as an advertisement in a clear and conspicuous manner;

Include the physical address of our business or headquarters;

Provide a clear and simple way to opt-out of receiving future email from you;

Honor opt-out requests promptly;

Monitor and supervise the conduct of third-party marketing entities that promote our website or products on your behalf.
Content Guidelines
As an affiliate of Bionic Gym, you agree not to make any medical claims about our products, including but not limited to claims of curing or treating any diseases or medical conditions. You also agree not to use stock photos in any of your advertising or promotion of our products.
Furthermore, you agree not to use lies, exaggeration, false claims, false reviews, false stats, or any other misleading or deceptive practices in your promotion of our products. You also agree not to engage in brand bidding on any advertising platform when promoting our products.
If we determine that any of your content violates these guidelines, we reserve the right to request that you remove the content immediately. Failure to do so may result in the termination of your affiliate relationship with us.
Termination
We reserve the right to terminate our affiliate relationship with you at any time, with or without cause. If we terminate the relationship without cause, we will pay you any commissions earned up until the date of termination. If we terminate the relationship with cause, you will forfeit any unpaid commissions.
Governing Law and Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of The Republic of Ireland without regard to its conflict of law provisions. Any legal action arising out of or related to this agreement shall be brought exclusively in the courts of the relevant jurisdiction.
Modification
We may modify any of the terms and conditions of this agreement at any time and at our sole discretion. You will be notified of any changes via email or by a posting on our website. If you do not agree with the changes, you may terminate your affiliate relationship with us.
Entire Agreement
This agreement constitutes the entire agreement between you and Bionic Gym and supersedes all prior agreements or understandings, whether written or oral, relating to the subject matter of this agreement.
By submitting your application, you acknowledge that you have read and agree to abide by the terms and conditions of this agreement, including the content guidelines for promoting our products.
