Welcome to BosilunLife Eco-Luxury Affiliate Partner Program! These Terms and Conditions govern participation in the BosilunLife Affiliate Program (the “Program”) by individuals or entities acting as affiliates (“you” or “Affiliate”) who promote BosilunLife’s products or services on behalf of BosilunLife (“we,” “us,” or “Merchant”). By joining or using the Program, you agree to be legally bound by these Terms and Conditions. If you do not agree to all of the terms, you may not participate in the Program.

1. Approval of Your Registration
All affiliate applications are subject to review. We reserve the right to approve or decline any registration at our sole discretion. If your application isn’t accepted, we truly appreciate your interest and hope to connect again in the future.

2. Affiliate Links and Coupon

• Once approved, you’ll receive an automatically generated affiliate link. You can also create custom links for specific products or collections through your Dashboard.
• If a customer clicks on multiple affiliate links, the most recent one (last click) is the one that earns the commission.
• You may be assigned a unique coupon code. Coupon usage rules and eligibility will be shown in your Dashboard.
• Please do not promote coupons that haven’t been specifically assigned to you.
• You’re welcome to promote your affiliate link on social media platforms, or through offline channels such as printed ads, magazines, or newspapers - as long as your content follows our terms and local advertising laws.

3. Commissions and Payment

• You will earn a 13% commission on every successful order made by a customer you refer through your affiliate link or assigned coupon code.
• Commission is calculated based on the order value, excluding taxes, shipping fees, and other extra charges.To receive a commission, you must enter your payment details in the Settings section.
• You can choose to be paid via PayPal or bank transfer.
  The payment schedule is shared in the Affiliate Guide and may vary based on your chosen method.
• Commissions are only paid for transactions that have been successfully completed and not refunded or charged back.
• We apply a fair use policy, which means BosilunLife has the right to review any referred order to ensure its validity.
• You can track your earnings in the Commission tab, and all processed payments will appear in the Payment tab.

4. Marketing Tools
We may provide you with promotional media - such as banners, logos, or specific campaign materials - through the Marketing Tool tab in your dashboard. You can download these assets or copy the HTML embed code to share them on your affiliate channels.

5. Cookie
We use a cookie to track people who click your affiliate link or use your coupon.

• The cookie stays active for 365 days.
• If a customer makes a purchase during that time, you’ll earn a commission, even if they don’t click the link again.
• If cookies are blocked or deleted by the customer, we can’t track the referral, and no commission will be paid.

6. Removal from Referral Program
If an affiliate wishes to be removed from the affiliate program, they can do so by contacting: antonio@bosilunlife.com

7. Prohibited Activities
To maintain the integrity of BosilunLife brand, affiliates must not engage in any of the following:

• Using spam (unsolicited emails or messages) to promote affiliate links.
• Misrepresenting BosilunLife products or making false claims.
• Offering cash-back, rewards, or incentives not provided by BosilunLife.
• Using cookie stuffing or any form of fraud to generate commissions.
• We review affiliate activity regularly to ensure fair use. If any of these rules are broken, it may lead to suspension or removal from the program and cancellation of unpaid commissions.

8. Relationship of the Parties
Participation in the Affiliate Program does not create any partnership, joint venture, agency, franchise, or employment relationship between you and BosilunLife. You operate as an independent party and do not have the authority to represent or bind BosilunLife in any way.

9. Termination and Modification
BosilunLife reserves the right to modify or terminate the Affiliate Program and these Terms at any time. You will be notified of any changes by email or through your affiliate dashboard. By continuing to participate in the Program after changes are posted, you accept the updated terms.

10. Confidentiality
Affiliates may have access to confidential information such as business strategies, pricing, and customer data. You agree to keep this information strictly confidential and not disclose it to any third party, during or after your participation in the Program.

11. Limitation of Liability
BosilunLife shall not be liable for any indirect, special, or consequential damages arising from or related to your participation in the Program. Our total liability will not exceed the total amount of commissions paid to you under this agreement.

12. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Portugal and applicable laws of the European Union, without regard to conflict of law principles.

This Privacy Policy of UpPromote about the Affiliate Marketing system describes how we may collect and use personal data and the rights granted to merchants, affiliates and customers regarding their respective data.

By joining the Affiliate program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.

Legal Basis for Processing
We process personal data under the following legal bases:

• Consent: When you have given clear consent for us to process your personal data for a specific purpose.

• Contractual Necessity: When data processing is necessary for the performance of a contract between you and BosilunLife or UpPromote.

• Legitimate Interests: For purposes that are in our legitimate interests and do not override your data protection rights, such as improving our services or ensuring security.

Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, including for legal, accounting, or reporting requirements. If you request, we will delete your personal information unless we are legally required or permitted to retain it.

We take appropriate technical and organizational security measures to protect your personal information from unauthorized access, loss, misuse, or alteration. These measures include encryption, secure servers, and limited access to personal data.

International Data Transfers
Your information, including personal data, may be transferred to—and maintained on—computers located outside of your country or other governmental jurisdiction where data protection laws may differ. Where required, we ensure appropriate safeguards, such as Standard Contractual Clauses, are in place.

Withdrawing Consent
Where processing is based on consent, you may withdraw your consent at any time. Withdrawing consent will not affect any data processed prior to withdrawal.

Third-Party Applications
The affiliate program operates through UpPromote, a third-party service provider. While we oversee and manage affiliate participation, UpPromote may process data as an independent controller. Please review their privacy practices if needed.

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote app by Children

UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through antonio@bosilunlife.com. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
