1. Content Guidelines

Caption Guidelines:

• Share honest product recommendations.

• Share our brand values that resonate with you most.

• Share product benefits as well as your personal results.

• Rave about the features you love the most! Ex: Scent, ingredients, texture or packaging.

Requirements:

• Tag us @cheeks.co + #aspaceforyou so that we can see and engage with your posts!

• Follow FTC guidelines.

• Share ONLY your honest opinions, findings, beliefs and experiences with Cheeks + Co.

Other Posting Requirements:

• All product claims that you make on social media must use the same (or similar) language as claims made on our product pages: cheeks.co

• Avoid making claims that our products are “pregnancy-safe.” As with any skincare or supplement, pregnant or breastfeeding mothers should follow their doctor’s guidance.

• Avoid stating or suggesting that  Cheeks + Co and third party products will treat or prevent any disease or medical condition, including, but not limited to acne, psoriasis, or rosacea. Avoid describing our products as non-toxic, organic and all-natural.

• Your content should not infringe upon the copyright, trademark, privacy, publicity or other personal or property rights of any person or entity.

• Content that is lewd, obscene, sexually explicit, pornographic, disparaging, defamatory promotes racism, bigotry or hatred; infringes on any intellectual property rights or is otherwise in violation of any copyright or trademark law; or otherwise inappropriate at Cheeks+Co sole determination may not be posted and Cheeks+Co, in its sole discretion may remove such content or require that you remove such content.

• Content will not violate any law.

2.Commissions:

• - PAID THROUGH PayPal, Affiliate must provide an email address connected to their Paypal account.

• - Action Locking Actions are locked 1 month(s) after the end of the month they are tracked.

• - Invoicing Actions are invoiced on the 15th of the month after they lock. Payout Scheduling Approved transactions are paid no later than 7 day(s) after the end of the day they are invoiced.

• - Financial transactions covered by this insertion order will be processed in the USD currency. Currency exchanges will occur when you or your partner(s) have set a different default currency in account settings.

3. Paid Search Policy

• Our affiliate program strictly does not allow paid search bidding on all Brand and Product keywords including variations or misspellings. This includes Cheeks.co, Osea, Josh Rosenbrook, Chunks, Kate Corn, Thomas Grove, MicroCurrent, Salt & Stone, TidalShift, SurfaceMoves, etc. 

• Protected SEM Bidding Keywords You may NOT bid on any of our trademarked terms (cheeks+co, cheeks.co), including any variations or misspellings thereof for search or content-based campaigns on Google, MSN, Yahoo, Facebook or any other network. Negative Matching for Protected Keywords Required Recommended SEM Bidding Keywords 

• You may NOT use our trademarked terms in sequence with any other keyword (i.e. Cheeks  Coupons, Cheeks Discounts). Prohibited SEM Display URL Content You may NOT use our trademarked terms in your ad title, ad copy, display name or as the display URL. Prohibited SEM Ad Copy Content You may NOT use our trademarked terms in your ad title, ad copy, display name or as the display URL. Direct linking (Use of Display URL) No Special Instructions for Search Marketing Publishers We strongly suggest you add our trademarked terms as negative keywords. 

• We have a strict zero-tolerance policy on PPC trademark bidding. You will forfeit all commissions for a minimum of the past 30 days and you will be terminated  from our program without warning if you engage in PPC trademark bidding that uses our trademarked terms. 

4. Coupon Policy Coupons and Promotional Codes

•  Publishers may only use coupons and promotional codes that are provided exclusively through the affiliate program 

• Special Instructions We reserve the right to reverse any commissions generated from unauthorized coupon codes obtained from any non-affiliate marketing channel. Posting any information about how to work around the requirements of a coupon/promotion will result in removal from the program. Furthermore, you may not use any technology that covers up the coupon code or gives the appearance that any ongoing offer requires clicking, to generate the affiliate click.

5. Prohibited Website Content. 

• Use of Logos and Trademarks in Web sites Publishers/Affiliates have the right to use our banners and logos provided within this affiliate program. No other logos or trademarks may be used without prior permission from the merchant. Promotional Methods Incentivized Traffic Allowed - Affiliates must be clear on the associated incentives and cannot mislead customers to generate clicks and/or orders. Email Allowed - Emails must be branded as the affiliate and cannot impersonate the merchant's email. Prior permission must be received for 3rd party email buys that are outside the affiliates own subscriber list. Software Not allowed Sub-Affiliates Allowed - Must pass the sub-affiliate identifiers to monitor performance on the sub-affiliate level. 

• Social Media Allowed - Affiliates may not present themselves as the merchant or impersonate the merchant or its employees in any way.

6. Termination:

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements (false claims, misleading hyperlinks, etc.).

• Spamming (mass email, mass newsgroup posting, etc.).

• Advertising on sites containing or promoting illegal activities.

• Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.

• Self referrals, fraudulent transactions, suspected Affiliate fraud.

• In addition to the foregoing, Cheeks & Co. reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.

7. Liability:

Cheeks + Co will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

8. Term of the Agreement

The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any changes.

WHO IS COLLECTING YOUR DATA AND WHY?

CHEEKS, LCC dba Cheeks & Co ("us," "we," or "our") offers and maintains the website(s) located at cheeks.co, including all subdomains and subparts, as well as our social media accounts on Facebook, Instagram, and other platforms (collectively, the “Site”). When you visit the Site, you may choose to provide us with personal data that identifies you. This Privacy Policy explains how we process and use your personal data, and it applies regardless of how you access the Site. Please take time to read this Privacy Policy carefully. 

WHAT IS THE PERSONAL DATA COLLECTED FROM AFFILIATES?

• We collect your name, social media handles, email addresses, physical address, phone numbers.

• We track your sales through a third party affiliate management system, which you sign up for inorder to work with our affiliate program.

HOW DO WE USE YOUR DATA

We use your Personal Data for the purposes for which you provided it, including to:

• Fulfill your product or service needs;

•  Register your online account;

• Maintain our own accounts for payments and delivery;

•  Advise you about products, services, offers, or events that may be of interest to you

•  Track your sales; and

•  Track the clicks and views that you bring to our site.

HOW DO WE SHARE YOUR PERSONAL DATA?

No Sale of Personal Data

We will not sell your Personal Data to third parties, including third party advertisers. There are, however, certain circumstances in which we may disclose, transfer, or share your Personal Data with certain third parties after obtaining your consent.
