Club Athletica Affiliate Program Terms and Conditions

Welcome to Club Athletica! Thank you for joining our Affiliate Program. By participating in this program, you agree to the following terms and conditions.

1. Approval or Rejection of Registration

We reserve the right to approve or reject any Affiliate Program registration at our sole discretion. You will not have legal recourse against us for the rejection of your application.

2. Affiliate Links and Coupons

An affiliate link is automatically generated for you. You may also generate specific affiliate links for products or collections. If someone clicks on a different referral link before using yours, your link will be the one that counts.
You may or may not be assigned a coupon code. If assigned, details of the code and its usage will be clarified in your Affiliate Dashboard. Note: You cannot promote a coupon code without being assigned one.
If a customer clicks your link and uses a coupon code, you will not receive double commission for that transaction.

3. Commissions and Payment

You will earn commissions based on the value of the purchase made through your affiliate link (excluding tax, shipping, and additional fees).

To receive payments, you must enter your payment details or select the store credit option under Settings in your Affiliate Dashboard. Club Athletica is not liable for commissions withheld due to incomplete payment information.

Affiliates cannot earn commissions by using their own 10% shareable discount codes on their personal purchases. Attempting to do so is considered self-referral and is strictly prohibited.

Payment schedules are available via the Affiliate Guide page. Payments are only made for successfully completed transactions. Transactions that result in chargebacks or refunds will not be paid. We reserve the right to review all referral orders under our fair use policy.

4. Marketing Tools

We may share promotional materials such as banners, logos, and collection promotions via the Marketing Tools tab. You can download or embed these materials to use on your affiliate channels.

5. Network

If the Network tab is activated, affiliates can invite others to become part of their downline. If any downline affiliate generates a sale, the upline affiliate will also receive a commission, based on the merchant’s settings.
To invite affiliates, share your network link. Any affiliate who signs up through your link will be considered part of your downline.

6. Cookies

We use cookies to track customers who click on your link. If a customer disables or clears cookies, we cannot track their purchases and cannot pay commissions on those transactions.

Cookies will track customer activity for a specified number of days as defined in the Affiliate Registration Form. Any purchase made during this window will be attributed to you, even if the customer doesn’t click the link again.

7. Removal from the Affiliate Program

To request removal from the program, contact: customerservice@clubathletica.com.au

8. Consent to Receive Marketing Content

By submitting the affiliate registration form, you consent to receive content from Club Athletica via email and SMS for marketing purposes.

9. Misuse of Affiliate Code and Paid Advertising

Affiliates are strictly prohibited from using their affiliate codes in conjunction with general discount codes not assigned to them. Paid advertising (e.g., Google Ads or sponsored search) that promotes affiliate codes or links outside of organic content is also not permitted.

Codes and links must only be shared on personal and approved platforms like Instagram or TikTok. Any misuse will result in removal and forfeiture of earned commissions.

10. Unauthorized Use of Affiliate Codes

Affiliates are prohibited from manipulating checkout processes, such as applying affiliate codes without customer knowledge or overriding other codes. Using your code on orders that do not belong to you or in situations where a customer entered a different code is considered fraud and will result in removal.

11. Affiliate Code Use and Brand Representation

Affiliates must represent Club Athletica in a positive, accurate, and professional manner. Use only approved logos and materials, and avoid misleading claims. Violations may result in removal from the program.

12. Prohibited Content

Affiliates must not use or associate Club Athletica with offensive, illegal, discriminatory, or otherwise inappropriate content. Violating this rule will result in immediate removal.

13. Modifications to Terms and Conditions

Club Athletica reserves the right to amend these terms at any time. Continued participation after updates constitutes acceptance of the revised terms.

14. Affiliate Program Termination

We reserve the right to terminate your participation at any time, with or without cause. Valid commissions from eligible transactions before termination will still be honored.

15. Affiliate Program Fraud Prevention

We conduct ongoing fraud monitoring to protect program integrity. Fraudulent activity—including fake traffic, self-referrals, or manipulation of codes—will lead to account suspension and commission forfeiture.

16. Affiliate Responsibility for Taxes

Affiliates are solely responsible for paying any applicable taxes on earned commissions. Club Athletica does not provide tax advice and is not liable for personal tax obligations.

Club Athletica Affiliate Program Privacy Policy

This Privacy Policy describes how we may collect, use, and protect personal data, as well as the rights granted to merchants, affiliates, and customers regarding their respective data. By joining the Club Athletica Affiliate Program, you signify your approval of the terms outlined in this Privacy Policy and agree to comply with our Terms and Conditions.

If you do not agree with this Privacy Policy, please do not use the affiliate marketing system.

We may update this Privacy Policy from time to time to reflect changes in our privacy practices or for operational, legal, or regulatory reasons. By continuing to use the affiliate program after these changes are posted, you agree to the revised policy.

Personal Information Controller

All personal information provided to or collected by Club Athletica under this Privacy Policy will be stored and controlled by Club Athletica (the data controller).

Information Collected from Merchants

When a merchant uses the affiliate system, we automatically gain access to certain types of information from your Shopify account (such as email, first name, last name, shop information including shop domain, currency, and address). This information helps us provide the services necessary to manage your affiliate program, verify your identity, contact you, provide customer support, and engage in marketing activities.

Information Collected from Affiliates

When you sign up as an affiliate, we collect some basic information such as:

• Email address

• Personal details

• Payment details

• Social network information

This information helps merchants evaluate the affiliate's potential, process specific activities within the affiliate app, and contact the affiliate as needed for program-related matters.

Information Collected from Customers

When customers visit a merchant’s website and make a purchase, Club Athletica’s system will collect information such as:

• Order total

• Order items

• Order ID

This information is used to track referral orders and to ensure affiliates receive commissions for referred sales.

About Cookies

"Cookies" are small data files placed on your device or computer that often include a unique identifier. These are created when a user’s browser loads a website, and the website sends information to the browser to create a text file. Every time the user returns to the website, the browser sends this file back to the server.

Information Sharing

We value your privacy and do not share your personal information with third parties except as described in this Privacy Policy. We may share personal information with third-party service providers who perform functions on our behalf, such as:

Use of UpPromote App by Children

The Club Athletica Affiliate Program is not intended for individuals under the age of 13. If you are under 13, you may only use the program under the supervision of a parent or guardian.

We recognize that you have rights over your personal information. We take reasonable steps to allow you to:

If you are an affiliate and wish to exercise these rights, please reach out directly to the merchant you interacted with, as we serve as a processor on their behalf and can only forward your request to them.

Data Retention

We will retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce agreements. When personal information is no longer needed, we will take steps to securely delete or anonymize it.

Third-Party Websites and Services

The Club Athletica Affiliate Program may include links to third-party websites or services that are not operated by Club Athletica. We are not responsible for the content, privacy practices, or policies of these third-party websites. We encourage you to review the privacy policies of any third-party sites before providing any personal information.

Security of Personal Information

We take the security of your personal information seriously and employ reasonable security measures to protect it from unauthorized access, alteration, or destruction. By participating in our Affiliate Program, you acknowledge that your personal information may be transferred to, and maintained on, computers located outside of your jurisdiction. Affiliate Liability and Indemnity

Affiliates agree to indemnify and hold harmless Club Athletica, its officers, directors, employees, and agents from and against any claims, actions, demands, or losses arising from the affiliate’s breach of these Terms and Conditions or any other illegal activities related to the promotion of our products.

Marketing Communications

In addition to the communications related to your participation in the affiliate program, you may receive marketing content via email or SMS. You can opt out of receiving marketing communications at any time by following the unsubscribe instructions in the communication or by contacting us at customerservice@clubathletica.com.au.

Affiliate Program Fraud Prevention

Club Athletica reserves the right to conduct fraud prevention checks at any time to ensure the integrity of the affiliate program. If fraudulent activity is suspected, we will investigate and take appropriate action, which may include account suspension or permanent removal from the program. Any fraudulent activities, including but not limited to self-referring or generating fake traffic, will result in forfeiture of commissions and immediate removal from the affiliate program.

Governing Law

These Terms and Conditions and Privacy Policy shall be governed by and construed in accordance with the laws of [your jurisdiction]. Any disputes will be resolved in the competent courts of [your jurisdiction].

Affiliate Program Termination

Club Athletica reserves the right to modify, suspend, or terminate the affiliate program at any time, with or without notice. Affiliates will be notified of any changes to the program and, if necessary, given time to adapt to the new terms and conditions.

Affiliate Responsibility for Taxes

Affiliates are responsible for paying all applicable taxes on the commissions they earn through the affiliate program. Club Athletica will not be held liable for any taxes related to affiliate commissions. Affiliates should consult with a tax professional to ensure they comply with their local tax laws.
