Terms and Conditions

CMC Motorsports Creator Affiliate Program — Terms & Conditions
Version 2. Last updated: October 14, 2026

These terms are an agreement between CMC Motorsports LLC ("CMC," "we," "us") and you, the affiliate ("you"). They apply to everyone who joins on or after October 14, 2026. For affiliates who joined before October 14, 2026, these terms take effect on November 14, 2026; until then, the October 12, 2026 terms continue to apply to you (see Section 14). By registering for or taking part in the Program, you agree to these terms. If you don't agree, please don't register.

1. Joining the Program

  • Invite-only: The Program is for creators who make motorsport content for a real audience. We invite creators to join, and we review every application. We may approve or decline any application at our discretion.

  • What we look for: original F1, motorsport, sim-racing or car-culture content posted in the last 90 days; an engaged audience, judged on recent views and engagement rather than follower count; and an audience mostly in countries CMC ships to.

  • Verification: You must be at least 18, give accurate information, and verify that you control the social account you'll promote on (we use UpPromote's bio-code check). You must list every website, channel and handle you'll use to promote CMC ("declared channels").

  • Payment and tax details: Your PayPal account must be in your own name or your registered business's name, and you must upload a completed Form W-9 (U.S.) or the applicable Form W-8 (non-U.S.) before your first payout.

  • One account: One account per person or business. Duplicate accounts may be merged or closed.

2. Your Link and Discounts

  • Tracking: Your affiliate link is created automatically, and you can create links to specific products or collections from your dashboard. Referrals are tracked for 30 days after a customer clicks your link, and the most recent affiliate click gets the credit. Customers must have cookies enabled; if they block or clear cookies, the sale can't be tracked.

  • Link discounts: If your program includes a customer discount, it's applied automatically at checkout when a customer arrives through your link. There's no code to share.

  • Personal codes: We issue a personal coupon code only by exception (for example, for podcasts or spoken video where a link can't be clicked). If we issue you one, only you may promote it, and only on your declared channels. If a customer uses one affiliate's link and another affiliate's code, the code's owner gets the credit. An order earns one commission.

  • Your program: Your commission rate, any customer discount and your payout method are set by the program you're in, as shown in the Benefits section of your registration page and in your dashboard.

3. How You May Promote

  • Allowed: Your own declared social channels, websites, videos, podcasts, newsletters and print, with honest content about products we actually sell.

  • Disclosure: Every time you promote CMC, clearly disclose that you earn a commission, for example "I earn a commission from CMC Motorsports" or "#ad". Put it at the start of the post, caption or video, close to your link, where people will see it before they click. Don't hide it among hashtags, behind a "more" link or only in your bio. For videos and podcasts, say it out loud too. This is required by the FTC's Endorsement Guides and other advertising laws.

  • Compliance checks: If we ask, you'll promptly send copies or links of your CMC promotions so we can check them against these terms.

  • Not allowed:

    • Paid advertising of any kind that promotes CMC, uses our names or links to cmcmotorsports.com, directly or through a redirect, landing page or your own site, unless we've approved it in writing first. This includes search ads on any search engine (including Google, Microsoft Bing, Yahoo and DuckDuckGo), whatever the keyword or campaign type; shopping, display, video and retargeting ads; paid social ads and boosted or promoted posts (including on Facebook, Instagram, TikTok, YouTube, X, Reddit, Pinterest and Snapchat); native, pop-up and push ads; and paid placements on ad networks, apps or newsletters.

    • Bidding on, or using in domain names, social handles, ad copy or business names, "CMC Motorsports," "CMC," our domains, or misspellings or variations of them, or the names of teams, drivers or series together with "coupon," "promo code" or "discount."

    • Coupon, deal, cashback, rebate, loyalty, price-comparison or "review" sites and apps, and browser extensions or toolbars, whether you run them or place our links or codes on them.

    • Posting codes or links anywhere other than your declared channels, or letting others republish them.

    • Sub-affiliate networks, incentivized traffic (paying people to click or buy), spam, purchased email lists, misleading claims or product claims you can't back up, fake reviews, cookie stuffing, hidden frames, forced clicks, pop-ups or any other deceptive traffic.

    • Pretending to be CMC Motorsports or any team, driver, series or licensor, or suggesting that any of them endorse you or that you're an official partner.

    • Creating your own versions of team, driver, series or CMC logos, wordmarks or other branded artwork. Use only the assets we provide in the Marketing Tools tab.

4. Self-Referrals

The Program rewards you for referring other customers. It isn't a way to get a personal discount. Orders you place for yourself don't earn commission. Orders that ship to you and also use additional discount codes break these terms; pending commissions on those orders won't be approved, and your account will be closed.

5. Commissions

  • Tiers: New creators start in a Probation program for at least 90 days. You're eligible for a Proven program when, over a full 90-day period, you've referred at least 25 eligible orders and at least 75% of them came from first-time CMC customers. We review tiers quarterly and may move you up or back based on these measures. A move to a lower-rate program takes effect 30 days after we notify you.

  • Probation programs: 10% commission with no customer discount; or 5% commission plus a 5% customer discount through your link; or 15% paid as CMC store credit.

  • Proven programs: 15% commission with no customer discount; or 8% commission plus a 7% customer discount through your link; or 22.5% paid as CMC store credit.

  • What counts: Commission is calculated on the product amount of each eligible referred order, as shown on that referral in your dashboard. Tax, shipping, fees and tips don't earn commission.

  • What doesn't earn commission:

    • Sale or marked-down items, gift cards and pre-order items.

    • Orders from wholesale, trade or business (B2B) customers, and orders placed through a draft order, invoice or quote.

    • Orders that use a private CMC discount code that wasn't issued to you (for example a staff, customer-service, wholesale or another partner's code), unless we confirm in writing that it can be combined with your referral. Public site-wide offers, like our welcome or pop-up codes, are fine when the customer arrived through your link; commission is calculated on the product amount after that discount.

    • Orders traced to traffic that isn't from your declared channels, or to any method Section 3 doesn't allow.

    • Orders that are canceled, refunded, returned, charged back or found to be fraudulent. If one of these happens after you've been paid, we'll reverse the commission on that order, show the adjustment in your dashboard, and deduct it from future commissions or, to the extent the law allows, ask you to repay it.

  • Review and holding period: Every referral order is reviewed. Commissions stay pending for 90 days after the order date so our return window can close. After that, eligible commissions are approved.

6. Payouts

  • Method: Cash commissions are paid through PayPal to the PayPal email in your affiliate Settings, which must be in your own name or your business's name. Store-credit programs pay in CMC store credit, which can only be used on cmcmotorsports.com and can't be exchanged for cash.

  • Schedule: We process payouts once a month.

  • $50 minimum: Your approved cash balance must be at least $50.00 USD for a monthly payout to be sent. Balances under $50.00 carry over to the next month and don't expire while your account is active and in good standing. Only approved commissions count toward the minimum.

  • Fees: CMC pays the PayPal transaction fee on each payout.

  • Leaving the Program: If your account is closed and you haven't broken these terms, your approved balance is paid in the next monthly payout, even if it's under $50.00, once Section 7's tax forms are on file (if your dashboard is closed, we'll email you a secure way to provide them). Commissions still in the 90-day hold are paid in the first monthly payout after they're approved. In store-credit programs, approved commission is issued as store credit, and store credit already issued stays usable after your account closes. If we close your account for breaking these terms, commissions on orders that broke them are forfeited, to the extent the law allows.

7. Taxes

You're an independent contractor, not an employee, agent or partner of CMC. You're responsible for reporting and paying your own taxes. U.S. affiliates must upload a completed Form W-9, and non-U.S. affiliates must provide the applicable Form W-8 (such as W-8BEN). We'll hold payouts, and may delay approving payout requests, until valid tax forms are on file, and we may be required to withhold tax if they aren't provided. We'll issue IRS information returns (such as Form 1099) when the law requires them.

8. Marketing Tools and Trademarks

We may provide banners, logos, product images and collection assets in the Marketing Tools tab. You may use them only to promote CMC Motorsports while you're an active affiliate. You may resize them, but don't alter, recreate or remove any logos or notices. The CMC Motorsports name and logo, and any team, driver and series names and marks, are protected by intellectual property rights, and rights in third-party marks stay with their owners. Taking part in the Program doesn't give you any rights to them.

9. Network

If CMC turns on the Network tab, you can invite other people to join as your downline using your network link. Downline affiliates must be approved under Section 1 and follow these terms. When a downline affiliate makes an eligible sale, you earn the network commission shown in your dashboard.

10. Changes and Ending the Program

We may change these terms, commission rates, programs or the payout minimum. We'll give at least 30 days' notice by email or in your dashboard before a change takes effect. Changes apply going forward and don't reduce commissions you've already earned. If you don't accept a change, you can leave the Program before it takes effect; continuing after that means you accept it. Either of us may end your participation at any time. We may close accounts that have had no referred sales for 90 days and, after we ask, don't show reasonable evidence of promotion on their declared channels during that period. To leave, email rfalco@cmcmotorsports.com.

11. Liability

The Program is provided "as is" and "as available," without warranties of any kind. To the extent the law allows, we aren't liable for indirect or consequential damages, or for lost commissions caused by tracking outages, cookie blocking or third-party platform problems, and our total liability to you won't be more than the commissions you earned in the 12 months before the claim. You agree to indemnify CMC against third-party claims and reasonable costs arising from your promotions, your infringement of anyone's rights or your breach of these terms. Nothing in these terms limits liability that can't be limited by law.

12. Governing Law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute must be brought in the state or federal courts located in Monmouth County, New Jersey, and both parties consent to their jurisdiction.

14. Affiliates Who Joined Before October 14, 2026

This section applies if you received our October 14, 2026 email inviting you to continue in the Program. Until November 14, 2026, your current program, rate and coupon code stay as they are. To stay in the Program after that, by November 13, 2026 reply to that email with the channels you promote on and the Probation program you want, make sure your PayPal account is in your own or your business's name, and upload your W-9 or W-8 in your affiliate dashboard Settings. If you do, we'll move you into the Probation program you choose on November 14, 2026 and replace any public code with a link discount (or a personal code under Section 2, if you qualify). You can also leave before then without accepting the new terms. If you don't reply by November 13, 2026, we'll treat that as declining the new terms and end your participation on November 14, 2026 under Section 10, and Section 6's leaving rules apply to any approved or held commissions. The $50 minimum in Section 6 applies to you from November 14, 2026.
