WE'RE LOOKING FOR BRAND AMBASSADORS

Terms & Conditions

By applying for this position, you agree to be bound by these terms and conditions (our Brand Ambassador Policy). If you do not agree with any of the terms of this policy, then you should not take part in this application process.

1. THE POLICY

This Brand Ambassador Policy (“this policy”) is the official brand ambassador policy of EMPRESS ATHLETICUS PTY LTD ACN 647 499 447 and any of its wholly owned subsidiaries (hereafter collectively referred to as the “EMPRESS ATHLETICUS Group” or “we”, “us” or “our”). 

2. WHAT IS AN AMBASSADOR

We are opening our doors to anyone and everyone who loves taking photos and who shares our Empress Athleticus Ethos.

We are looking for brand ambassadors that share our love of supporting women. There are no size requirements, we’ve opened this to women of all sizes and shapes.

Starting from Monday 12th July 2021 we will announce that we are looking for our very own Brand Ambassadors via a post on our Facebook & Instagram account.

As a Brand Ambassador, successful prize winners will have the opportunity to post and share positive photos and messages in association with our brand for a period of 3 months and earn a commission from sales generated through the use of your Ambassador unique code, which we will provide. 

3. HOW TO BECOME AN AMBASSADOR

The Ambassador Program is free to enter and no purchase is necessary. 

Only one entry will be accepted per person. Multiple entries from the same person will be disqualified. 

To apply send an email to madi@empressathleticus.com.au with your Instagram handle and Facebook profile link, along with a brief outline of why you think you'd be perfect for this position. 

Applications will open 12:00 AEST on Monday 12th July 2021 (“opening date”) and will close 12:00 AEST on 31st July 2021 (“closing date”).

Applications that are late, lost, delayed, misdirected, incomplete or cannot be delivered or entered for a technical or other reason will not be accepted.

This position is in no way sponsored, endorsed, administered by or associated with Instagram or Facebook. By entering, entrants confirm the release of Instagram and Facebook of responsibility for this prize draw and agree to Instagram and Facebook’s Terms of Use.

4. ELIGIBILITY AND SELECTION CRITERIA

Applicants must be aged 18 years or over to participate in the Ambassador Program. 

We reserve the right to ask any winner to provide proof of age.

Applicants must have a valid email address and valid Facebook and Instagram account to participate in the Ambassador Program.

Applicants must also reside within countries eligible to receive deliveries from us – if you reside within a country in which we cannot deliver, you are ineligible to participate in the Ambassador Program. 

We reserve all rights (at our sole discretion) to decide if the eligibility criteria is met and/or to disqualify you from the Ambassador Program if your conduct is contrary to the spirit or intention of the position.

In applying for the Ambassador Program, you confirm that you are eligible to do so and eligible to claim any prize you may win.

5. HOW ARE BRAND AMBASSADORS SELECTED?

To be a successful applicant your current content must be on brand for Empress Athleticus. We support women & encourage everyone to love themselves as they are.

Recommended but not required 10,000+ followers on Instagram as you will be given a swipe up link that you will make commission on.

 6. NOTIFICATION OF PRIZE WINNERS

You will be advised via email  what tier of our Ambassador Program you've been approved for once your application has been approved.

Successful applicants will be notified via email during the month of July 2021. We may extend the application period at any time at our discretion. 

Our decision regarding any aspect of the application process is final and binding and no correspondence will be entered into about it.

If an applicant does not respond to the email within 48 hours of being notified by us, then they will forfeit their position and we may offer the position to the next eligible entrant.

We must either publish or make available information that indicates that we've selected our Brand Ambassador/s. To comply with this obligation we will send the surname and country of the winners to anyone who emails a request to hello@empressathleticus.com.au within 1 month after the closing date.

We will announce via our Facebook & Instagram account our Brand Ambassadors in either the Empress social channel stories or comments of our application announcement posts.

If you have an objection to any or all of your surname and county being published or made available, please email us at hello@empressathleticus.com.au. In such circumstances, we must still provide the information to the relevant authority on request.

We reserve the right to withdraw an ambassadorship (or any part of it) if an applicant breaches any of these terms and conditions or if they are found to have acted in a dishonest or fraudulent manner.

7. CONDITIONS OF AMBASSADOR PROGRAM

Successful applicants will receive a pack of our gear to showcase throughout your Ambassadorship.

Minimum post requirements are 2 x Posts & 2 x Story’s per month. The Ambassadorship will run for 3 months.

To make money from this experience you will receive a swipe up link to shop and a unique coupon code for you to share on your Story and Instagram posts. Each sale generated from these will earn you a percentage of the sale. If orders are submitted without using your coupon code, these orders will not be credited to your account and there will be no cash compensation provided by us. Only one coupon code may be applied per order.

You agree that you are not an employee of Empress Athleticus for any reason.  Your commission comprises the whole of your remuneration from us for your shared content and you must pay your own costs of creating and sharing your content.  

You agree that social media can be a sensitive environment.  You agree that you will not share images, information or other materials in connection with our brand, that are or may be considered discriminatory, defamatory, offensive, or objectionable in any way.  Empress Athleticus does not endorse any particular religious or political views, you must not share content, in association with our brand, that purports to endorse any religious or political views.

You agree that you will not resell any of our products, whether on websites on the internet or retail establishments, without our consent. The extent of your Ambassadorship is limited to your promotion of our brand and sharing of the swipe up link and code for your followers to shop with us.  You must not use the swipe up link and code to purchase items yourself for resale by you or any other person. 

As your Ambassadorship is a prize, you agree that we may terminate your Ambassadorship by written notice to you at any time and for any reason.  You specifically agree that we may terminate your Ambassadorship if we form the reasonable opinion that:

1. you have breached the terms of this Policy; or
2. your current or past content negatively impacts on our brand or image.

If we terminate your prize Ambassadorship, we must still pay you your commission on any orders submitted with your code prior to the termination, subject always to our rights against you in case of a breach of this Policy.  You will not have any other claim against us in connection with the termination and must not represent yourself as an Ambassador or in any other way connected with our business after the termination of your Ambassadorship, except as we may agree in writing. 

6. PUBLICITY & DATA PROTECTION

By applying for an Ambassadorship, you agree that we may re-post, publicise and otherwise use any text, photographs, graphics, video or audio or any other materials that you post in connection with your Ambassadorship (including as part of the entry process or as part of a prize) or if you tag or mention @Empressathleticus in any such content, whether via the same platform that you posted or shared the content, as well as via other social media platforms that we use, and on our websites and this right continues despite expiry or termination of your Ambassadorship. 

If you are a winner, we will contact you with further details if we want to get you involved in any publicity and/or events that we have planned.

We will only process your personal data in accordance with our Privacy Policy and as set out in these terms and conditions with regard to the announcement of the successful applicants and fulfilment, delivery and arrangement of the Ambassador Packs. By applying for an Ambassadorship, you declare that you have read and are satisfied with our Privacy Policy. 

7. LIMITATION OF LIABILITY

You agree to share and post at your risk and insofar as is permitted by law, we, our affiliates, agents, distributors, representatives and/or employees will not in any circumstances be responsible or liable to compensate any winner or accept liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by our negligence or the negligence of our affiliates, agents, distributors, representatives and/or that of our employees. Your statutory rights are not affected.

8. GOVERNING LAW & JURISDICTION

These terms and conditions will be governed by laws of Queensland, Australia.

We and you each agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia in the Brisbane CBD.
