Ambassador Program
The following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and an ambassador (“you” or “affiliate” or "ambassador") who refers customers to use product or service from the merchant.
By participating in the Program, Ambassadors agree to use the Program in the specified manner and to be bound to these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an Ambassador or participate in the Program in any manner.
1. Approve or Reject of the Registration
We reserve the right to approve or deny ANY Ambassador Program Registration in our sole and absolute discretion. You will have no legal resource against us about the denial of your Ambassador Program Registration.
2. Ambassador Links and Coupon
The Ambassador link is automatically generated, but you can also generate an ambassador link for a specific product or collection. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.
Ambassador might or might not be assigned to one coupon code with details and usage clarified on Dashboard. If customer click on the ambassador link and use coupon code, you will not receive a double commission. If you’re not assigned to a branded coupon, then you won’t be allowed to promote the coupon.
Ambassadors may also advertise merchant website on online channels such as Facebook, Instagram, TikTok or offline classified channel ads, magazines, and newspapers.
3. Commissions and payment
You can refer any customer to make a purchase on our website, and you will receive a 15% commission, calculated based on our commission structure. The commission amount depends on the order value and does not include any extra fees (tax, shipping cost, etc.). Please note that garments on sale with 75% off or more are excluded from the commission. Kindly be aware that these conditions are subject to change without notice.
To receive a commission as an Ambassador, please ensure that you have provided your payment details in the Settings section. Payments will be processed during the first 5 business days of the following month, with monthly cuts. Commissions will only be issued for transactions that have been successfully completed. Kindly note that the Ambassador Program is subject to a fair use policy, allowing the merchant to review each referral order. You can check the status of your commission in the Commission tab, and any paid commission will be listed in the Payment tab. Please be aware that transactions resulting in chargebacks or refunds will not be eligible for payment.
4. Marketing tool
We may share promotion media such as banners, logos or specific collection promotions to you through Marketing tool tab. You can download the media or get the HTML embed code in order to share on affiliate channels.
5. Network
If Network tab is activated, ambassador can invite others to become their downline affiliate. If any downline affiliate brings order to merchant shop, upline affiliate will also get network commission which depends on merchant settings.
To invite other affiliates into the system, share network link and any other affiliate who click on that link and sign up will become a downline affiliate.
6. Confidentiality clause
The contents of these terms and conditions and all agreements entered into are confidential information. You may not disclose the contents of the commercial agreements entered into.
7. Cookies
We use cookies to track people who have clicked on your link, it is necessary that the prospective customer has accepted the use of cookies within the website.
If a person doesn't allow cookies or clears their cookies then we can't track them so we won’t be able to pay earnings on that person's activity.
We will be using 15 days of cookie tracking. The first tracking day will start from the time a customer clicks on the ambassador’s link or uses the coupon. Within the cookie time, every order made by this customer at the merchant website will automatically result in commissions to the ambassador (There’s no need for the customer to click on the affiliate link then).
8. Activities that are not allowed
For the safety of your followers and our business relationship, it is important that you consider these activities as not allowed within the advertising activity:
8.1. Use of the image of a minor or a person who has not given his or her express consent for his or her image to be used.
8.2. Political content material.
8.3. Software viruses.
8.4. Links that lead to external websites.
8.5. Advertising material that infringes a patent, copyright, trademark, slogan, trade secret or otherwise infringes intellectual property rights.
8.6. Illegal, offensive, obscene, threatening, defamatory or any other content that leads to discrimination of persons based on race, sexual orientation or nationality.
9. Removal from Referral Program
If an ambassador wishes to be removed from the ambassador program, they can ask for it by contacting: info@especia.com

10. Some recommendations to consider

10.1. Identify when there is a business relationship with an advertiser: please analyze in detail the presence of elements that demonstrate the presence of a commercial relationship between advertiser and influencer - ambassador. Since you have a fully identified commercial relationship, it is very important that you make it clear to your followers and your community that your publications and what you are transmitting through your social media is the product of a commercial relationship with a company.
10.2. Ask the company that hires your services to indicate which are the guidelines to fully identify the message as an advertisement: As we explained you in the advancement of the terms and conditions, it is important that in the development of the commercial relationship, the company that hires you must provide you with guidelines on how the publication will be classified as advertising.
10.3. Please refrain from passing off an advertising message as a natural and spontaneous one arising from personal experience: It is very important to keep in mind that you should not convey an advertising message as if it were one that comes from your experience. This is because there must be complete transparency regarding what you share with your audience through your social media.
