Terms and Conditions

EVA ATHLETIC AFFILIATE PROGRAM

Welcome to EVA Athletic! We're excited to have you on board as part of our Affiliate Program.

These terms and conditions apply to individuals accessing or using the program both as a merchant (“we”, “our”, or “merchant”) and as an affiliate (“you” or “affiliate”) who refers customers to products or services offered by EVA Athletic.

By participating in the Program, you agree to use the Program in the manner specified in—and be bound by—these Terms and Conditions. If you do not agree to these terms in full, you are not authorised to register as an Affiliate or participate in the Program.

1. Approval or Rejection of Registration

We reserve the right to approve or reject any Affiliate Program application at our sole discretion. You will have no legal recourse against EVA Athletic for the rejection of your application.

2. Affiliate Links and Coupon Codes

  • Your affiliate link is automatically generated, but you can also create links for specific products or collections.

  • If a customer clicks multiple affiliate links, the most recent one clicked will be the one that earns the commission.

  • You may be assigned a unique coupon code. Details about your code (if applicable) will appear in your Dashboard.

  • If a customer uses both your affiliate link and your coupon code, only one commission is applied—not both.

  • If you're not assigned a branded coupon, you are not permitted to promote any coupon codes.

Affiliates may advertise EVA Athletic through online channels such as Facebook, Instagram, and other digital platforms, or through offline media like print ads, magazines, and newspapers.

3. Commissions and Payments

  • Commissions are calculated based on the order value, excluding fees such as taxes and shipping.

  • EVA Athletic reserves the right to change commission rates at any time.

  • You must complete your payment details under Settings in order to receive payouts.

  • Commission payments are made for successfully completed transactions only. Orders that are refunded or charged back will not result in a commission.

  • EVA Athletic has a fair use policy in place and reserves the right to review any referred transaction.

  • The status of your commissions is viewable in the Commission tab, and completed payouts will appear in the Payment tab.

  • Commissions will not be paid for traffic generated via discount code/referral websites (e.g. Coupon Birds).

4. Marketing Tools

We may provide promotional materials such as banners, logos, and campaign creatives. These can be downloaded or shared using HTML embed codes available in the Marketing Tools tab of your Dashboard.

5. Network Referrals (If Applicable)

  • If the Network tab is enabled, you can invite others to join as your downline affiliates.

  • You will earn a network commission when your downline makes successful referrals, depending on merchant settings.

  • To invite others, share your network link. Anyone who signs up through that link becomes your downline affiliate.

6. Cookie Tracking

  • We use cookies to track affiliate referrals. If a user disables cookies or clears their browser cache, tracking will not occur, and commission cannot be paid.

  • The cookie duration (number of tracking days) is stated in your affiliate registration.

  • Within the cookie window, all purchases made by the referred customer will generate a commission—even if they do not click your link again.

8. Content Requirements

  • Affiliates ("Athletes") will create original, honest, and appropriate content.

  • Pre-approval from EVA Athletic is not required for posting on your personal profile.

  • All posts must tag our social handle: @eva.athletic

  • Content must comply with the platform’s terms and remain suitable for all audiences (no vulgarity or offensive material).

  • EVA Athletic reserves the right to request edits to content involving brand representation, especially if created in a gym or promotional setting.

9. Copyright & Media Usage

EVA Athletic retains the copyright of any media created under the program. However, both the affiliate and EVA Athletic may share the content across their respective platforms.

10. Commission Eligibility & Payment Withholding

EVA Athletic reserves the right to withhold or deny payment of any commissions if, at our sole discretion:

  • The referred transaction is found to be fraudulent, refunded, or subject to a chargeback.

  • The affiliate has violated these Terms and Conditions or failed to follow proper referral guidelines.

  • The traffic or referral originates from unapproved coupon, discount, or cashback websites.

  • The affiliate fails to provide complete and accurate payment or tax information.

  • There is suspicion of self-referrals or order manipulation intended to gain commissions.

Commission eligibility is subject to validation, and EVA Athletic maintains the right to audit, review, or revoke commissions at any time.

Privacy Policies

This Privacy Policy outlines how personal data is collected, used, and protected through our Affiliate Marketing System, powered by UpPromote. It applies to merchants, affiliates, and customers engaging with the program.

By participating in the Affiliate Program, you confirm your agreement with the terms set out in this Privacy Policy. If you do not agree with any part of this policy, you should not use or access the Affiliate Marketing System.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. Continued use of the Affiliate Program after changes are published constitutes your acceptance of the revised policy.

1. Personal Information Controller

All personal information provided to or gathered by EVA Athletic via the UpPromote system is stored and controlled by UpPromote (as the data controller). EVA Athletic also acts as a data handler in accordance with privacy regulations.

2. Information We Collect

a) From Merchants

When a merchant installs and uses the UpPromote app, we may access certain Shopify account details including:

  • Email address

  • First and last name

  • Shop details (domain, address, currency, etc.)

This information is used to verify identity, provide customer support, manage affiliate activities, and for relevant marketing and service communications.

b) From Affiliates

When you register as an affiliate, we collect:

  • Name and contact details

  • Payment information

  • Social media profiles (if provided)

  • Other personal information used to assess eligibility and performance

This helps us communicate with you, manage your account, track performance, and process commissions.

c) From Customers (for referral tracking)

When a customer visits a merchant’s website and makes a purchase via an affiliate link, we may collect data such as:

  • Order ID

  • Order total

  • Order contents

This data is solely used to track referral activity and calculate affiliate commissions.

3. Cookies

Cookies are small data files stored on your device to enable referral tracking. These help us identify customers who came through your affiliate link.

4. Information Sharing

We do not sell or disclose your personal information to unrelated third parties.

We may share data with trusted service providers who help us operate the affiliate program (e.g., email systems, analytics platforms). These providers are required to process your data only as instructed and in compliance with this Privacy Policy.

We may also disclose personal information:

  • If required by law

  • With your prior consent

  • To protect our rights, systems, or users

5. Children’s Privacy

The Affiliate Program is not intended for children under the age of 13. If you are under 13, you may only use the system with the consent and supervision of a parent or guardian.

  • Withdraw consent or data portability (where applicable)
