Welcome to the Hooks & Needles Affiliate Program. By signing up to be an affiliate in the Hooks & Needles Affiliate Program, you agree to be bound by the following terms and conditions.
1. Enrollment in the Program
To enroll in the Program, you must submit a completed Program application through our website. We will evaluate your application and notify you of your acceptance or rejection. We reserve the right to reject any application, including but not limited to applications from websites that we deem to be inappropriate or incompatible with our business.
2. Affiliate Responsibilities
a. Marketing
You agree to market and promote our products and services through legitimate channels, including but not limited to, your website, email marketing, and social media.
b. Compliance with Laws
You must comply with all applicable laws, regulations, and guidelines, including the Federal Trade Commission (FTC) Act.
c. Prohibited Activities
You are prohibited from:
- Using any misleading or deceptive promotional methods.
- Engaging in cookie stuffing, which includes any practice where a cookie is placed on a visitor’s computer without the visitor having clicked on an affiliate link.
- Using coupon sites unless you have received explicit authorization from Hooks & Needles.
- Sending unsolicited commercial emails (spam) to promote our products.
- Misrepresenting our products or services.
3. Affiliate Links and Cookies
a. Links
Upon acceptance into the Program, you will have access to a range of affiliate links and banners. You are authorized to place these links on your website, emails, and other communications.
b. Cookies
When a user clicks on an affiliate link, a cookie is placed on their browser to track sales and referrals. This cookie is valid for 30 days. You must not modify or interfere with these cookies in any way.
4. Commissions
a. Earning Commissions
You will earn a commission for each sale that is made through your affiliate link. The current commission rate is 30%. Commissions are only paid on sales that are tracked and reported by our system.
b. Payment
Commissions are paid on a monthly basis. Payment will be sent through bank transfer.
5. Termination
a. By Either Party
Either you or Hooks & Needles may terminate this Agreement at any time, with or without cause, by giving the other party written notice.
b. By Hooks & Needles
We may terminate this Agreement immediately without notice if you violate any terms of this Agreement, including but not limited to engaging in prohibited activities or failing to comply with applicable laws and regulations.
c. Effect of Termination
Upon termination of this Agreement, you will immediately cease all use of and delete all affiliate links, and you will no longer earn commissions for any sales made after the termination date.
6. Limitation of Liability
Hooks & Needles will not be liable for any indirect, incidental, special, punitive, or consequential damages (including, without limitation, loss of revenue or profits) arising out of or relating to this Agreement or the Program, even if we have been advised of the possibility of such damages. Our total liability to you for any cause of action arising out of or related to this Agreement or the Program will not exceed the total commissions paid or payable to you under this Agreement.
7. Modification
We may modify any of the terms and conditions in this Agreement at any time at our sole discretion. You will be notified by email or through our website of any changes. Modifications may include, but are not limited to, changes in the payment procedures and Program rules. If any modification is unacceptable to you, your only option is to terminate this Agreement. Your continued participation in the Program following the posting of the changes or notice of the changes will indicate your agreement to the changes.
