Affiliate Obligations
As an affiliate, you must use the affiliate program in a manner that demonstrates common sense and respect for the rights of Julian Bakery and third parties.

 

Affiliates are strictly prohibited from making personal purchases through their own affiliate links or using their own affiliate discount codes. This practice is considered a violation of our terms and conditions. It's essential that our affiliate program is used as intended - to reward affiliates for directing new customers to our site. If Julian Bakery detects that an affiliate is using their own links or codes for personal purchases, we reserve the right to immediately terminate and delete the affiliate's account. We take this matter seriously, as it undermines the fairness and integrity of our affiliate program. We appreciate your understanding and compliance with these rules.

 

Intellectual Property
The Julian Bakery® Brand and all of its original content, related brands (ProGranola®, PureMonk®, PaleoThin®, among others), features, and functionality, including, but not limited to, logos, images, text, graphics, and icons, are owned by Julian's Foods, LLC and are protected by national and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Restrictions on Use
You may not use the Brand for any illegal or unauthorized purpose. You agree to comply with all laws, rules, and regulations (for example, federal, state, local, and provincial) applicable to your use of the Brand. You may not use the Brand to transmit any worms or viruses or any code of a destructive nature.

Referral Tracking
Julian Bakery will provide you with specific referral links to link advertisements and other marketing content to Julian Bakery. Julian Bakery will track users who have visited these links using cookies that last for 30 days. Only users who make a purchase while the cookie is active will be considered referrals, and only these users will earn an affiliate commission.

Commission Determination
Affiliates will receive a 5% commission on the sales amount of referrals. This commission will be based on the subtotal of the order, excluding taxes and shipping costs. Discount amounts are not considered when calculating the final commission. Julian Bakery reserves the right to reverse commissions due to refunded payments and erroneous crediting.

Payment
Payments are made to all affiliates between the 1st and the 10th day of every month. To be eligible for a payout, an affiliate's balance must reach a minimum amount of $10.00 USD by the last day of the previous month. Once a payout is processed, the affiliate's balance resets and starts counting toward the next month. If there's no payout on a certain month, the balance can accumulate until the minimum amount is reached. Balances can only accumulate during a calendar year. After the December payout (between the 1st and the 10th of January), all remaining balances are forfeited.

Termination of Agreement
If you fail to generate any referrals for a period of 12 consecutive months, your participation in the Affiliate Program may be terminated. In such a case, any accrued and payable commissions at the time of termination are forfeited, and the account will be deleted.

Re-entry into the Affiliate Program
If an affiliate has been removed from the program due to inactivity or non-compliance with these terms, they may re-apply to participate in the Affiliate Program by signing up as a new affiliate. However, Julian Bakery reserves the right to accept or deny any applications for re-entry into the Affiliate Program, regardless of previous participation status. This decision will be made at the sole discretion of Julian Bakery and may be based on factors including, but not limited to, past compliance with program terms, account activity, and alignment with Julian Bakery's brand values and objectives.

Modification
Julian Bakery reserves the right to update and change the terms from time to time without notice. Any new features that augment or enhance the current program, including the release of new tools and resources, shall be subject to these terms.

Limitation of Liability
Julian Bakery shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use of or inability to use the service.

By signing up to be an Affiliate in the Julian Bakery Affiliate Program, you agree to be bound by the terms and conditions stated above.

 

This Privacy Policy of UpPromote about the Affiliate Marketing system describes how we may collect and use personal data and the rights granted to merchants, affiliates, and customers regarding their respective data.
By joining the Affiliate Program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.
We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.


Personal Information Controller
Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants
When a merchant uses the app, we are automatically able to access certain types of information from your Shopify account, such as email, first name, last name, and shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, and provide you with advertising and marketing activities.

Information collected from Affiliates
When an Affiliate signs up to join a program, we collect some information to inform merchants, such as email, personal information, payment details, and social network information,...The information would help the merchant evaluate the affiliate's background and potential, along with process-specific activities within the app, and contact the affiliate if needed.

Information collected from Customers when visiting the merchant's website
In order to track referral orders, when customers visit a merchant website and make a purchase, the UpPromote system will collect information about orders, such as total orders, order items, and order ID,...

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data, and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions, and they must process the personal information in accordance with this Privacy Policy.
We may also disclose your personal information to any third party with your prior consent.

Use of the UpPromote app by Children
UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights
UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these rights, please contact us through affiliates@julianbakery.com. We may require that you provide us with acceptable verification of your identity before providing access to such information.
If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
