Thanks for joining our Membership Program.

These following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and a member  (“you” or “member”) who refers customers to use the product or service from the merchant.

By participating in the Program, member agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as a Member or participate in the Program in any manner.

1. Approve or Reject of the Registration

We reserve the right to approve or reject ANY Member Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Member Program Registration.

2. Member Links and Coupon

Member link is automatically generated, but you can also generate a member link for a specific product or collection. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.

Member might or might not be assigned to one coupon code with details and usage clarified on Dashboard. If customer both click on the member link and use coupon code, you will not receive a double commission. If you’re not assigned a branded coupon, then you’re not allowed to promote the coupon.

Member may also advertise merchant website on online channels such as Facebook, Instagram,... or offline classified channel ads, magazines, and newspapers.

3. Commissions and payment

Refer any customer to make a purchase on our website, you will get a commission amount which is calculated based on Commission structure. Commission amount is dependent on order value and not including extra fee (tax, shipping cost,...).

For a Member to receive a commission, you need to specify the payment details on Settings. Payment schedule will be notified on Members Guide page.

Payments will only be sent for transactions that have been successfully completed. Use of the Membership Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission if displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out. We also deduct automatically 5% withholding tax from our individual Members and 10% from the corporate counterpart for us to be Tax Compliant as required by the Bureau of Internal Revenue of the Philippines.

4. Marketing tool

We may share promotion media such as banner, logo or specific collection promotion to you through Marketing tool tab. You can download the media or get the HTML embed code in order to share on sales channels.

5. Network

If Network tab is activated, Member can invite others to become  part of their members group.

To invite other members into the system, share the members link and any other members/customers who click on that link and sign up will be attached to the referring members group structure.

6. Cookie

We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.

If a person doesn't allow cookies or clears their cookies then we can't track them so we can't pay earnings on that person's activity.

Cookies day is said on the Members registration form and is set for 24 hours only. The tracking day will start from the time a customer clicks on the Member’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the member (There’s no need for the customer to click on the member link then). But if the customer click another member link, the latter will take effect.

7. Removal from Referral Program

If a member wishes to be removed from the Membership program, they can do so by contacting: labyuco@gmail.com.

This Privacy Policy of LABYU Co. about Member Marketing system describes how we may collect and use personal data and the rights granted to LABYU Co.  regarding members respective data.

By joining the Member program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not  use our Referral/Members marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our members referral program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by LABYU Co. under this Privacy Notice will be stored and controlled by our Marketing Partner (the data controller).

Information collected 

When members use the LABYU Co. Membership Program/Referral System, we are able to access certain types of information from your account such as email, first name, last name. We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Members

When a Member signs up to join our program,  our Marketing Partner collect some information to inform LABYU Co. such as email, personal information, payment details and social network information,...The information would help LABYU Co. evaluate member background and potential, along with process specific activities within the app and contact the member if needed.

Information collected from Customers when visiting Labyu Co. website

In order to track referral order, when customers visit Labyu Co. website and make a purchase, our Marketing Partner system will collect information of order such as total order, order items, order ID,....

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.

Because cookies allow you to take advantage of some of Member/Referral marketing system’s essential features, we recommend that you leave them turned on.

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of  LABYU Co. System by Children

LABYU Co. system is not intended for children. If you are under 18 years old, you may use the member/referral marketing system only with the supervision of your parent or guardian.

Your Rights

We understand  that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, import, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through support@labyuco.com.  When you register,  Your Username, Full Name and Email Address will be locked and can no longer be edited. This is to ensure data integrity of each account. We may require that you provide us with acceptable verification of your identity before providing access/changes to such information.
