Makerflo Crafts Affiliate Terms & Conditions

Please read our Makerflo Crafts Affiliate Terms and Conditions (“Makerflo Crafts Terms”) as these terms are important. You must read and agree to these terms before participating in any of our Affiliate programs. These Makerflo Crafts Terms are written in plain language intentionally avoiding legalese to ensure that they may be clearly understood and followed by Affiliates.
As a condition in your participation in the Makerflo Crafts Affiliate Program, each Affiliate is responsible for ensuring that its employees, agents, and contractors comply with these Makerflo Crafts Terms. Each Affiliate may also be bound by the terms and conditions of a Third Party Affiliate Platform (the “Platform”) (“Third Party Terms”). Notwithstanding the foregoing, where any Third Party Terms contradict these Makerflo Crafts Terms, the Makerflo Crafts Terms shall govern. The Makerflo Crafts Terms are subject to change, be updated, or replaced, in which case all Affiliates will be notified electronically. If you don’t agree to the new terms, you can terminate your contract.
1. DEFINITIONS
1.1. As used in these Makerflo Crafts Terms:
(i) “We”, “us”, or “our” refers to Makerflo Crafts, our website, and any of our products or services.
(ii) “Affiliate Program” means our affiliate program as described in this agreement.
(iii) “you” or “your” or “Affiliate” means the party, other than Makerflo Crafts, entering into this agreement and participating in this Affiliate Program.
(iv) “Affiliate Link” means the unique tracking link you place on your site or promote through other channels.
(v) “our website” refers to the Makerflo Crafts properties located at www.makerflocrafts.com or www.makerflo.com
(vi) “your website” refers to any websites that you will link to our website;
(vii) “Program” refers to the Makerflo Crafts Affiliate Program.
(viii) “Customer” means the authorized actual user of the Makerflo Crafts Products who has purchased or signed up for the Makerflo Crafts products after clicking an Affiliate’s unique tracking link.
2. ENROLLMENT & AFFILIATE ACCEPTANCE
2.1 To enroll in our affiliate program, you must be actively teaching or educating in one or more of the following niches: sublimation, engraving, UV resin crafting, epoxy resin crafting, direct-to-film crafting, or UVDTF crafting. Proof of your educational content may be required during the application process. We reserve the right to approve or reject applications based on provided information.
2.2. After receiving your application, we will review your website and notify you of your acceptance or rejection into our Program. Please allow up to five (5) business days for your application to be reviewed. Before we accept an application, we may want to review your application with you, so we may reach out to you for more information. We may require that you complete certain requirements or certification(s) before we accept your application. If we do not notify you that you are accepted to participate in the Affiliate Program within thirty (30) days from the date of your application submission, your application is considered to be rejected.
2.3. We reserve the right to reject any application; however, we encourage you to contact us if you feel we have made an incorrect decision. Including all of the websites and social media links that you use in your profile will help us make a better decision.
2.4. Even if you are accepted to participate in the Program and your site or social platforms are later determined (in our sole discretion) to be unsuitable based on our criteria for the Program, we may terminate this agreement.
2.5 You will comply with the terms and conditions of this Agreement at all times, including any applicable Program Policies. If you are accepted to participate in the Affiliate Program, then upon notification of acceptance, the terms and conditions of this Agreement shall apply in full force and effect, until terminated, pursuant to the terms set forth below.
3. NON-EXCLUSIVITY
This agreement does not create an exclusive agreement between you and us. Both you and we will have the right to recommend similar products and services of third parties and to work with other parties in connection with the design, sale, installation, implementations, and use of similar services and products of third parties.
4. WEBSITE RESTRICTIONS
3.1. Your participating website(s) may be found unsuitable if it falls under any of the following conditions. Conditions are, but not limited to, sites that:
3.1.1. Infringe on our or anyone else’s intellectual property, publicity, privacy, or other rights.
3.1.2. Violate any law, rule, or regulation.
3.1.3. Contain any content that is threatening, harassing, defamatory, obscene, harmful to minors, or contains nudity, pornography, or sexually explicit materials.
3.1.4. Contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.
3.1.5. Contain software or use technology that attempts to intercept, divert, or redirect Internet traffic to or from any other website, or that potentially enables the diversion of affiliate commissions from another website. This includes toolbars, browser plug-ins, extensions, and add-ons.
5. LINKING TO OUR WEBSITE
5.1. Upon acceptance into the Program, links will be made available to you through the affiliate interface. Your acceptance in our program means you agree to and abide by the following:
5.1.1. You will only use linking code obtained from the affiliate interface.
5.1.2. You will not manipulate any linking code obtained from the affiliate interface.
5.1.3. All domains and social media handles that use your affiliate link must be listed in your affiliate profile.
5.1.4. Your Website will not in any way copy, resemble, or mirror the look and feel of our Website. You will also not use any means to create the impression that your Website is our Website or any part of our Website including, without limitation, framing of our Website in any manner.
5.1.5. You may not engage in cookie stuffing or include pop-ups, false or misleading links on your website. In addition, wherever possible, you will not attempt to mask the referring URL information (i.e. the page from where the click is originating).
5.1.6. Using redirects to bounce a click off of a domain from which the click did not originate in order to give the appearance that it came from that domain is prohibited.
5.1.7. If you are found redirecting links to hide or manipulate their original source, your current and past commissions will be voided or your commission level will be set to 0%. This does not include using “out” redirects from the same domain where the affiliate link is placed.
6. COMMISSION GENERATION
6.1. You are only eligible to earn commission on sales of qualifying products or qualifying actions occurring during the term of this agreement.
6.2. You will earn commission based on the net price, less any coupon or customer discounts, of qualifying products and/or on net new number of qualified actions, according to the current published rates established by Makerflo Crafts and communicated to you upon acceptance of this agreement. Commission regulation rules are subject to change.
7. PPC GUIDELINES
7.1. If you are enrolled in our Program and participate in PPC advertising, you must adhere to our PPC guidelines as follows:
7.1.1. You will not purchase ads that direct to your site(s) or through an Affiliate Link that could be considered as competing with Makerflo Craft’s own advertising, including, but not limited to, our branded keywords
7.1.2. You may not use our trademarked terms in sequence with any other keyword (i.e. Makerflo Crafts Coupons, Makerflo Coupons).
7.1.3. You may not use our trademarked terms in your ad title, ad copy, display name, or as the display URL.
7.1.4. You may not direct link to our website from any Pay Per Click ad or use redirects that yield the same result. Affiliate links must be directed to an actual page on your website.
7.1.5. You may not bid in any manner appearing higher than Makerflo Crafts for any search term in position 1-5 in any auction-style pay-per-click advertising program.
7.1.6. If you automate your PPC campaigns, it is your responsibility to exclude our trademarked terms from your program and we strongly suggest you add our trademarked terms as negative keywords. We have a strict no-tolerance policy on PPC trademark bidding. You will forfeit all commissions for a minimum of the past 30 days and your commission will be set to 0% without warning if you engage in PPC trademark bidding that uses our trademarked terms.
7.1.7 You may not bid on any of our trademarked terms (which are identified below), including any variations or misspellings thereof for search or content based campaigns on Google, MSN, Yahoo, Facebook or any other network.
7.1.7. Trademarked Terms: includes Makerflo, Makerflo.com, Makerflo Crafts, Makerflocrafts.com, Makerflo Craft, MakerfloCraft.com and any other marks registered in the U.S. and other countries.
7.1.8 You will not use your own Affiliate Link to purchase Makerflo Crafts products for yourself or your business.
8. COUPON GUIDELINES
8.1. If you are enrolled in our Program and your Website promotes coupon codes, you must adhere to our Coupon Guidelines as follows:
8.1.1. You may ONLY advertise coupon codes that are provided to you through the affiliate program, including the Platform.
8.1.2. Posting any information about how to work around the requirements of a coupon/promotion (i.e. first-time customers only) will result in removal from the program.
8.1.3. Coupons must be displayed in their entirety with the full offer, valid expiration date, and code.
8.1.4. You may NOT use any technology that covers up the coupon code and generates the affiliate click by revealing the code(s).
8.1.5. You may NOT advertise coupon codes obtained from any non-affiliate marketing channel, including coupon codes from our email, paid search, or any other non-affiliate advertising campaigns.
8.1.6. You may NOT give the appearance that any ongoing offer requires clicking from your website in order to redeem. For example, if all items on the site have free shipping over $100, you may not turn this into an offer that infers that the customer must click from your site to get this deal.
8.1.7. Additionally, if your website ranks on the first page of Google for terms related to our website or company name(s) combined with the words coupon, coupons, coupon code, promo code, etc., and/or your conversion rate exceeds 25%, you may be offered a lower commission than our standard rate to offset the reduced profitability of orders.
9. COUPON ATTRIBUTION & AUTHENTICATION
9.1. Affiliates whose primary business is posting coupons, who are viewed by the program as being a coupon site, and/or who are tagged as coupon in our system, may not be paid commissions for sales generated.
9.2. Valid codes are defined as codes that are made available to the affiliate channel in general, through newsletters, or through the Platform, and directly or privately to affiliates.
9.3. Posting your affiliate link on any coupon site, or a website that is primarily focused on providing coupons or discounts, is strictly prohibited.
10. SUB-AFFILIATE NETWORKS
10.1. Promoting Makerflo Crafts through a sub-affiliate network is permitted, however you must be completely transparent with regards to where traffic from your sub-affiliates originated. Sub- affiliate networks must ensure that all sub-affiliates promoting the Makerflo Crafts program adhere to our program terms and conditions. This includes restrictions on advertising through toolbars, browser extensions, and through any paid placements such as a pay-per-click campaigns. Sub- affiliate networks must also receive approval prior to allowing any type of coupon sub-affiliate to promote the Makerflo Crafts program.
10.2. Failure to comply with our sub-affiliate network terms may result in a loss and/or reduction of commission from sales made through any sub-affiliate that does not comply with our program terms.
11. DOMAIN NAMES
11.1. Use of any of our trademarked terms as part of the domain or sub-domain for your website is strictly prohibited (e.g., Makerflo.website.com or www.Makerflo-coupons.com are strictly prohibited).
12. ADVERTISING & PUBLICITY
12.1. You shall not create, publish, distribute, or print any written material that makes reference to our Program without first submitting that material to us and receiving our prior written consent.
12.2. If you intend to promote our Program via email campaigns, you must adhere to all applicable marketing, advertising, endorsement, and publicity laws including without limitation the following:
12.2.1. Abide by the CAN-SPAM Act of 2003 (Public Law No. 108-187) with respect to our Program.
12.2.2. Email must be sent on your behalf and must not imply that the email is being sent on behalf of Makerflo Crafts.
12.2.3. Emails must first be submitted to us for approval prior to being sent or we must be sent a copy of the email.
DOING BUSINESS WITH MAKERFLO CRAFTS OUTSIDE OF THE AFFILIATE PARTNER PROGRAM. You are permitted to work with other teams inside the Makerflo Crafts organization; however, you must first get the consent of the Makerflo Crafts affiliate team. In addition, you must ensure that you adhere to all program terms and conditions, which includes being completely transparent with the Makerflo Crafts affiliate team about the relationships you hope to develop inside the Makerflo Crafts organization.
13. SOCIAL MEDIA
13.1. Promotion on Facebook, Instagram, YouTube and other social media platforms is permitted following these general guidelines: You ARE allowed to promote offers to your own lists; more specifically, you’re welcome to use your affiliate links on your own Facebook, Instagram, YouTube, etc. pages. For example: You may post, “25% off sale at Makerflo Crafts through Wednesday with code Makerflo25.” You will not advertise Makerflo Crafts through any paid media such as search engine ads, display advertising, paid social advertising such as Facebook ads.
13.2. According to current FTC guidelines, social media posts on your own social accounts must include appropriate hashtags. Hashtags and disclaimers are subject to change over time and it’s your responsibility to review and comply with current guidelines as policies may change over time.
13.3. You ARE PROHIBITED from posting your affiliate links on Makerflo Craft’s Facebook, Twitter, Pinterest, etc. company pages in an attempt to turn those links into affiliate sales.
13.4. You ARE PROHIBITED from running Facebook, Instagram, YouTube, or other social media ads with Makerflo Craft’s trademarked company name.
13.5. You ARE PROHIBITED from creating a social media account that includes Makerflo Craft’s name and/or any Makerflo Crafts trademark in the page name and/or username.
14. NON-DISPARAGEMENT
14.1. You agree, for the term of being an Affiliate of Makerflo Crafts and for five (5) years after, not to disparage Makerflo Crafts, its officers, directors, employees, shareholders, and agents, in any manner likely to be harmful to its or their business, business reputation, or personal reputation.
15. OPERATIONS OUTSIDE THE UNITED STATES
15.1. If you are conducting business in or taking orders from persons in other countries, you will follow the laws of those countries. For example, you will comply with the European Union’s Privacy and Electronic Communications Directive if you are conducting business in or taking orders from persons in one or more of the European Union countries.
16. REVERSAL & COMMUNICATION POLICY
16.1. Makerflo Crafts reserves the right to reverse orders due to order cancellations, duplicate tracking, returns, disputed charges, and program violations as outlined in these terms and conditions.
16.2. If asked for clarification or more information on any orders or clicks that we suspect may be in violation of our terms and conditions, you shall respond in a timely and honest manner. Below are violations of our communications policy:
16.2.1. You are not forthcoming, you are intentionally vague, or are found to be lying.
16.2.2. You are not responsive within a reasonable time period and after multiple attempts to contact you with information listed in your network profile.
16.2.3. You cannot substantiate or validate the source of your traffic to our program with clear and demonstrable proof.
16.3. If any of the above apply, then we reserve the absolute right to reverse orders, set your commission to 0%, and/or suspend you from the program for the period or orders in question.
16.4. We know that many violations are a result of automated processes; however, it is incumbent upon each affiliate to ensure that it has the appropriate checks and balances in place to proactively address these issues and adhere to our program rules.
17. FTC DISCLOSURE REQUIREMENTS
17.1. You shall include a valid and properly drafted disclosure statement within any and all pages, blog/posts, and/or social media posts where affiliate links for our affiliate program are posted as an endorsement or review, and where it is not clear that the link is a paid advertisement. This disclosure statement should be clear and concise, stating that we are compensating you for your review or endorsement. If you received the product for free from us or from the affiliate management team for review, this also must be clearly stated in your disclosure.
17.2. Disclosures must be made as close as possible to the claims.
17.3. Disclosures should be placed above the fold; scrolling should not be necessary to find the disclosure. (e.g. Disclosure should be visible before the jump).
17.4. Pop-up disclosures are prohibited.

18. PROHIBITION AGAINST SOLICITATION FOR RESIDENT AFFILIATES IN SELECT STATES
18.1. As a condition of its participation in the Makerflo Crafts Affiliate Program, Affiliate agrees that its solicitation activities on behalf of Makerflo Crafts within Arkansas, California, Connecticut, Georgia, Illinois, Kansas, Maine, Minnesota, Missouri, New Jersey, New York, North Carolina, Pennsylvania, Rhode Island, and Vermont (hereinafter “these states”) shall be limited to only providing a link on Affiliate’s website to Makerflo Craft’s own website.
18.2. Affiliate acknowledges that under current law in these states, further solicitation and promotional activities by Affiliate may render Makerflo Crafts liable for collecting sales tax on all sales to customers in these states. Therefore, as a condition of participation in the Makerflo Crafts Affiliate Program, Affiliate is prohibited from engaging in any solicitation activities in these states intended to refer potential customers to Makerflo Crafts, including, but not limited to:
18.2.1. Distributing flyers, coupons, newsletters, and other printed materials, or electronic equivalents of such materials;
18.2.2. Engaging in verbal solicitation, including in-person referrals or initiating telephone calls; and
18.2.3. Sending emails intended to refer customers to Makerflo Crafts.
18.2.4. Proof of compliance must be sent to Makerflo Crafts on an annual basis (by May 31 of each year) or affiliate may be removed from the program.
18.3. Affiliate further acknowledges that state tax laws are subject to change at any time and such changes may render Affiliates in certain states ineligible for continued participation in Makerflo Craft’s Affiliate Program. Makerflo Crafts reserves the right to remove any Affiliate from the Makerflo Crafts Affiliate Program at any time for any reason.
18.4. This section only applies to affiliates that constitute organizations, clubs, and nonprofit groups.
18.5. Affiliate shall maintain prominently on its website information alerting its members to the prohibition against solicitation activities in these states as described above.
