This Agreement (the "Agreement") is entered into by and between Maraluxo Hair (the "Company"), and the undersigned Affiliate (the "Affiliate"). By participating in the Maraluxo Hair Affiliate Program, the Affiliate agrees to the terms and conditions outlined in this Agreement.
1. Program Overview
The Maraluxo Hair Affiliate Program allows hair stylist , influencers, content creators to represent and promote Maraluxo’s hair extensions and other premium hair care products in exchange for commission’ discount and free products. The Affiliate will promote Maraluxo Hair through various social media platforms, such as Instagram, TikTok, Facebook and or YouTube.
2. Requirements to join the Maraluxohair Ambassador Program:
5000 followers on Instagram, TikTok, and YouTube
Content is hair, beauty, lifestyle, or fashion-focused and shared consistently
Preferably having experience wearing and/or styling hair extensions
Must be following @maraluxohair on Instagram, TikTok, and YouTube
Public social networks and a creator account
At least 4 pieces of content per month: 1 video (IG/TT/YT), 1 image (IG), OR 1(IG) story set with (3) frames, with at least one of them having a clickable link
Must use #maraluxohair for tracking
Featuring what hair length, method, and shade in the caption
Posts must tag @maraluxohair and the tag must be visible and clickable
3. Minimum Term of Collaboration
The Affiliate agrees to a minimum commitment of three(3) months starting from the date of acceptance into the program. The contract can be renewed or terminated by either party after the initial term.
4. Compensation and Benefits
As part of the Affiliate Program, the Affiliate will receive:
20% commission on net sales made using the Affiliate's unique referral code or link
Access to discounted Maraluxo products for content creation
Occasional free products at the Company’s discretion, based on campaign needs and performance
Promotion of Affiliate’s content on Maraluxo Hair’s official social media platforms and website
5. Affiliate Responsibilities
The Affiliate agrees to:
Post at least 4 pieces of content per month, such as videos, stories, photos, or reviews, featuring Maraluxo Hair products
Follow Maraluxo Hair’s brand guidelines, which will be provided, including how to present the products, tag the brand, and use specific hashtags
Ensure all content prominently features Maraluxo Hair products and no other competing hair brands in the same post
Include the required tags, mentions, and hashtags in all promotional posts
6. Brand Exclusivity
While Affiliates may promote other brands, the following applies:
The Affiliate may not promote any other hair brands in the same post or content that promotes Maraluxo Hair
Exclusive promotion of Maraluxo Hair products in all posts related to the brand
If other hair brands are promoted, they must be kept separate from Maraluxo Hair posts
7. Conduct and Content Restrictions
The Affiliate agrees to:
Not alter or distort the appearance of Maraluxo Hair through excessive filters or edits
Not post nude, sexually suggestive, or inappropriate content in any promotional post
Not remove, alter, or cover any brand tags, hashtags, or mentions from the content. Failure to comply with this may result in the termination of the agreement and the requirement to refund the full value of any products received
Ensure content aligns with Maraluxo Hair's brand image and does not harm the brand reputation
Not post content that may be deemed discriminatory, offensive, or harmful to the brand image
8. Termination and Refund Policy
The Company may terminate this Agreement if:
The Affiliate violates any terms of this Agreement or acts in a way that harms the brand’s reputation
The Affiliate fails to create the required content or adhere to the brand’s guidelines
The Affiliate is found to have misused Maraluxo Hair products in a way that negatively impacts the brand image
In the event of termination due to non-compliance or content removal (e.g. failure to use required tags, mentions, or alteration of content), the Affiliate agrees to:
Return or reimburse the Company for any free or discounted products received, based on the fair market value of the products
Cease all promotional activities on behalf of Maraluxo Hair
9. Intellectual Property and Content Usage
The Affiliate retains ownership of all created content. However, by participating in this program, the Affiliate grants Maraluxo Hair the right to use, share, and promote the content on the Company’s official website, social media, and marketing materials. The Company may edit or repurpose the content for promotional purposes.
10. Payment Terms
Commissions will be calculated monthly and paid via PayPal. Payments will be processed at the end of each month for all sales made during the preceding month. The Affiliate is responsible for ensuring their PayPal account details are correct and up to date.
11. Governing Law
This Agreement will be governed by the laws of the Province of Quebec, Canada. Any disputes or issues arising from this Agreement will be subject to the jurisdiction of Quebec courts.
12. Agreement Acceptance
By joining the Maraluxo Hair Affiliate Program, the Affiliate acknowledges and agrees to the terms outlined above. This document represents the entire agreement between the parties and supersedes any prior agreements.
