Affiliate Agreement This agreement describes the terms and conditions for participation in the One Tough Mother affiliate program. In this agreement, the term "Affiliate" refers to you (the expert). In this agreement, “One Tough Mother” refers to One Tough Mother, a British Columbia-based business, with whom you are entering this agreement. By confirming your affiliate account, you are confirming that you have read this agreement and agree to the terms and conditions.
Commissions For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate. Commissions can be viewed on the Affiliate Dashboard.
Payment An Affiliate can request a payment when their balance reaches a minimum balance of $50 CAD. Payments can be requested every 30 days. Payment processing can take up to 30 days from the request date. Payments will generally be paid out via e-transfer.
Refunds In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.
Usage and Obligations Affiliates are permitted to use the One Tough Mother brand and marketing resources available. The Affiliate does not gain any trademark, copyright or any other rights to these materials.
The Affiliate will never imply that they are acting on behalf of One Tough Mother and will not act as a reseller.
The Affiliate will never represent themselves, One Tough Mother or their relationship with One Tough Mother in a false or misleading way.
The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing One Tough Mother.
Term and Termination Either party has the right to terminate the agreement immediately without prior notice.
If One Tough Mother chooses to terminate the agreement, any balance greater than $30 CAD will be paid to the affiliate within 60 days of termination. Balances that are smaller than $30 will be forfeited.
Governing Law This Agreement shall be governed, construed, and enforced in accordance with the laws of the Province of British Columbia, without regard to its conflict of laws rules.
Arbitration All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the Province of British Columbia. An award of arbitration may be confirmed in a court of competent jurisdiction.
Modification We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate Program rules.
Personal Information Controller
Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).
Information collected from Merchants
When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.
Information collected from Affiliates
When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.
Information collected from Customers when visiting merchant website
In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

Use of UpPromote app by Children
UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.
UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through firstname.lastname@example.org. We may require that you provide us with acceptable verification of your identity before providing access to such information.
If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
