These Affiliate Program Terms and Conditions ("Terms") govern your participation in the Paganheim Affiliate Program ("Program"). By applying to or participating in the Program, you ("Affiliate" or "you") agree to these Terms. If you do not agree, do not apply or participate.
1. Program Overview
Paganheim ("we," "us," or "Merchant") operates an e-commerce store at paganheim.com ("Site"). The Program allows approved Affiliates to earn commissions by referring customers to the Site using unique tracking links or codes provided through UpPromote.
2. Eligibility and Application
- You must be at least 18 years old and legally capable of entering contracts.
- We review applications and may approve or reject them at our sole discretion. We may reject or terminate participation without notice for any reason, including incomplete applications or suspected fraud.
- Approval is not guaranteed. We may require additional information (e.g., social media profiles, audience details).
3. Affiliate Obligations
- Promote the Site and products ethically and in compliance with all laws, including Australian Consumer Law (ACL), AANA Code of Ethics, and FTC guidelines (if targeting US audiences).
- Clearly disclose your affiliate relationship (e.g., "#ad," "affiliate link," "I earn a commission if you purchase through my link") in all promotions. Failure to do so may result in immediate termination.
- Do not:
- Use misleading claims, spam, or unauthorized paid search (e.g., bidding on our brand terms).
- Promote on coupon/deal sites without permission unless using our approved codes.
- Engage in self-referrals, cookie stuffing, or fraud.
- Infringe trademarks or use our branding without approval.
- You are responsible for your content and any taxes on commissions.
4. Commissions and Payments
- Commission rate: 10% of net sale value (excluding shipping, taxes, refunds).
- Commissions accrue only on valid, completed orders tracked via your unique link/code within the 30-day cookie window.
- Payouts: Monthly via PayPal, minimum threshold $50 AUD. Paid within 30 days of month-end after refunds/chargebacks.
- We reserve the right to withhold/charge back commissions for refunds, fraud, or policy violations.
5. Tracking and Attribution
- We use UpPromote for tracking. Cookies last 30 days. We are not responsible for tracking failures due to ad blockers, browser settings, or affiliate error.
- Disputes over attribution must be raised within 60 days.
6. Intellectual Property
- We grant you a limited, non-exclusive license to use our approved logos, banners, and links for promotion.
- You may not modify them or use them in a way that implies endorsement beyond the affiliate relationship.
7. Termination
- Either party may terminate at any time with written notice.
- We may terminate immediately for breach (e.g., fraud, non-disclosure, spam).
- Upon termination, you stop using our materials; unpaid commissions may be forfeited if due to breach.
8. Limitation of Liability
- To the maximum extent permitted by law, we are not liable for indirect, consequential, or punitive damages.
- Total liability is limited to commissions paid in the prior 12 months.
9. Governing Law
These Terms are governed by the laws of South Australia, Australia. Disputes are resolved in the courts of South Australia.
10. Changes to Terms
We may update these Terms at any time. Continued participation constitutes acceptance. Check this page regularly.
