Affiliate Program Terms and Conditions

Welcome to PowerFood! Thanks for joining our Affiliate Program.

The following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to use products or services from the merchant.
By participating in the Program, the Affiliate agrees to use the Program in the manner specified in, and is bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an Affiliate or participate in the Program in any manner.

1. Approval or Rejection of Registration
We reserve the right to approve or reject ANY Affiliate Program Registration at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

2. Affiliate Links and Coupon Codes
- An affiliate link is automatically generated, but you can also create a specific affiliate link for a product or collection. If a person clicks on someone else’s referral link and later clicks on yours, the last click will count.
- Affiliates might or might not be assigned a coupon code with specific details and usage clarified in their Dashboard. If a customer clicks on the affiliate link and uses the coupon code, only one commission will be paid.
- If you are not assigned a branded coupon, you are not permitted to promote or use the coupon code.

**Important Restriction:** Affiliates are prohibited from placing orders using their own affiliate link or coupon code. If such activity is detected, the related commission will be voided, and the affiliate may face removal from the program.

Affiliates may promote the merchant’s website through online channels such as Facebook, Instagram, classified ads, magazines, or newspapers.

3. Commissions and Payments
- You will earn a commission for any customer referred by you who makes a qualifying purchase on our website. Commission amounts are based on the order value, excluding fees such as tax or shipping.
- To receive commissions, payment details must be specified in the Settings section. Payment schedules are detailed in the Affiliate Guide.
- Commissions are subject to review, and payments will only be issued for successfully completed transactions. Orders resulting in chargebacks, cancellations, or refunds will not earn commissions.
- Abuse of the Affiliate Program, including self-referrals, fraudulent activities, or misrepresentation, will result in the forfeiture of all commissions and removal from the program.

4. Marketing Tools
We provide promotional materials such as banners, logos, or special promotions via the Marketing Tool tab. Affiliates can download these assets or use the provided HTML embed codes to share them on their channels.

5. Network Referrals
- If the Network feature is enabled, affiliates can invite others to join as their downline affiliates.
- The upline affiliate will earn a network commission based on the sales generated by their downline affiliates, subject to merchant settings.
- Affiliates can invite others using their unique network link. Anyone who clicks the link and signs up will automatically be added to their downline.

6. Cookies
- We use cookies to track referrals. If a person does not allow cookies or clears them, we cannot track their activity, and no commission will be earned.
- Cookie duration is specified during affiliate registration. Any orders made by the referred customer during the cookie period will earn commissions for the affiliate, even if the customer does not click the link again.

7. Prohibited Activities
The following activities are strictly prohibited and may result in removal from the Affiliate Program:
- Placing personal orders using your own affiliate link or coupon code.
- Engaging in fraudulent practices, including generating fake referrals or manipulating tracking.
- Misrepresenting the merchant’s products or promotions.
- Using unauthorized coupon codes or promotional materials.


8. Removal from the Affiliate Program
Affiliates may request removal from the program by contacting: info@powerfood.shop.

If you violate these terms, we reserve the right to remove you from the Affiliate Program at any time, and any unpaid commissions may be forfeited.

This Privacy Policy of UpPromote about Affiliate Marketing system describes how we may collect and use personal data and the rights granted to merchants, affiliates and customers regarding their respective data.

By joining the Affiliate program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote app by Children

UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through info@powerfood.shop. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
