Affiliate Program Terms and Conditions
Welcome to prospectorsdream.com! Thanks for joining our Affiliate Program.
These following terms and conditions apply to individuals who are accessing or using the Program both as the merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to use products or services from the merchant.
By participating in the Program, you agree to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an affiliate or participate in the Program in any manner.
1. Approval or Rejection of the Registration
We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.
2. Affiliate Links and Coupons
Your affiliate link is automatically generated, but you can also generate an affiliate link for a specific product or collection. For a sale to be attributed to you, a customer must click on your affiliate link and complete a purchase before the cookie expires. If a person clicks on someone else’s referral link and then later clicks on yours, your link will be the one that is credited for the sale.
You may or may not be assigned a unique coupon code. If you are assigned a coupon code, its details and usage will be clarified on your Dashboard. If a customer both clicks on an affiliate link and uses a coupon code, you will not receive a double commission. If you are not assigned a branded coupon, then you are not permitted to promote coupon codes in any way.
3. Prohibited Promotional Methods: Paid Search (PPC) Policy
We run our own paid search campaigns, and it is critical that our affiliates do not compete with our efforts. Therefore, affiliates ARE NOT PERMITTED to engage in any form of paid search advertising, including but not limited to Google Ads, Bing Ads, or any other search engine marketing (SEM), for the purpose of driving traffic directly to prospectorsdream.com.
Violation of this policy will result in immediate termination from the program and forfeiture of all outstanding and future commissions.
This prohibition includes, but is not limited to, the following:
Direct Linking: You may not create paid search ads that link directly to prospectorsdream.com or any of its subdomains.
Bidding on Branded/Trademarked Keywords: You may not bid on our branded keywords or any misspellings or variations thereof. This includes keywords such as:
Use of Our Brand in Ad Copy: You may not use our brand name, trademarks, or any variations thereof in the headline, body copy, or display URL of your paid search ads.
Ad Hijacking: You may not create ads that impersonate our official ads or could cause customer confusion.
This policy is in place to prevent brand confusion, protect our trademark, and avoid affiliate competition with our own marketing campaigns. Affiliates are encouraged to use paid search to direct traffic to their own websites or landing pages, which can then link to prospectorsdream.com.
4. Approved Promotional Methods
Affiliates are welcome to advertise the merchant website on approved online channels such as personal blogs, websites, Facebook, Instagram, X (Twitter), TikTok, and email newsletters, or through offline channels such as magazines and newspapers, provided these promotions comply with all other terms outlined in this agreement.
5. Commissions and Payment
When you refer a customer who makes a valid purchase on our website, you will be eligible to receive a commission amount which is calculated based on our Commission Structure. The commission amount is dependent on the net order value and does not include taxes, shipping costs, or other fees.
For an affiliate to receive a commission, you must specify your payment details in your account Settings. The payment schedule will be detailed on the Affiliate Guide page or your dashboard.
Payments will only be sent for transactions that have been successfully completed and are past any applicable refund period. The use of the Affiliate Program is subject to a fair use policy which gives the merchant the right to review each and every referral order. The status of your commissions is displayed in the Commission tab. Transactions that result in chargebacks or refunds will not be paid out.
6. Marketing Tools
We may share promotional media such as banners, logos, or specific collection promotions with you through the Marketing Tool tab. You can download this media or get the HTML embed code in order to share it on your affiliate channels.
7. Network (Sub-Affiliates)
If the Network tab is activated, you may be able to invite others to become your downline affiliate. If any downline affiliate brings a valid order to the merchant shop, the upline affiliate may also get a network commission, which depends on the merchant's settings. To invite other affiliates into the system, share your unique network link. Any affiliate who signs up through that link will become your downline affiliate.
8. Cookie Policy
We use a cookie to track individuals who have clicked on your affiliate link. For tracking to work, the user’s browser must have cookies enabled. If a person does not allow cookies or clears their cookies, we cannot track their activity and therefore cannot pay earnings on that person's activity.
The cookie duration is stated in the Affiliate registration form. The tracking period begins the moment a customer clicks on the affiliate’s link. Within the cookie duration, any eligible order made by this customer on the merchant website will automatically result in commissions to the affiliate, even if they visit the site directly on subsequent occasions.
9. Removal from the Program
If an affiliate wishes to be removed from the affiliate program, they can do so by contacting us at: nate@prospectorsdream.com. We reserve the right to terminate any affiliate from the program at any time for violation of these terms and conditions, or for any other reason in our sole discretion.
10. Modification of Terms
We reserve the right to modify these Terms and Conditions at any time. You will be notified of any significant changes via the email address associated with your affiliate account. Your continued participation in the program following any such modification constitutes your agreement to the new terms.
