AFFILIATE AGREEMENT

This agreement describes the terms and conditions for participation in the Public Watch affiliate program. In this agreement, the term "Affiliate" refers to you (the applicant). In this agreement, “Public Watch” refers to Public Watch, with whom you are entering this agreement. By applying to the Public Watch affiliate program you are confirming that you have read the agreement and agree to the terms and conditions.

COMMISSIONS

For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate. Commissions can be viewed on the Affiliate Dashboard.

PAYMENT

An Affiliate can request a payment when their balance reaches a minimum balance of RM 100. Payments can be requested every 30 days. Payment processing can take up to 30 days from the request date. Payments will generally be paid out via bank transfer.

REFUNDS

In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.

USAGE AND OBLIGATIONS

Affiliates are permitted to use the Public Watch brand and marketing resources available in the Affiliates section of the Public Watch application. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials. The Affiliate will never imply that they are acting on behalf of Public Watch and will never advertise Public Watch products directly. The Affiliate will never bid for advertisements that compete with Public Watch. The Affiliate will never represent themselves, Public Watch or their relationship with Public Watch in a false or misleading way. The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing Public Watch.

TERM AND TERMINATION

Either party has the right to terminate the agreement immediately without prior notice. If the Affiliate terminates the agreement, no further commissions from Public Watch will be paid for any past or future customer transactions. If Public watch chooses to terminate the agreement, any balance greater than RM100 will be paid to the affiliate within 60 days of termination. Balances that are smaller than RM100 will be forfeited. If the Affiliate is on a recurring program, Public Watch will not be obligated for any future payments after termination.

MODIFICATION

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate Program rules.

This Privacy Policy of Public Watch Malaysia about Public Watch Affiliate Program: Affiliate marketing system describes how we may collect and use personal data and the rights granted to merchants, affiliates and customers regarding their respective data.

By joining the Affiliate program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by Public Watch Malaysia under this Privacy Notice will be stored and controlled by Public Watch Malaysia (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate the affiliate background and potential, along with process specific activities within the app and contact the affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, Public Watch Malaysia system will collect information of order such as total order, order items, order ID,....

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analysing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of Public Watch Affiliate Program by Children

Public Watch Affiliate Program is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parents or guardian.

Your Rights

Public Watch Malaysia understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through cs@publicwatch.com. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
