SHAHKAAR AFFILIATE PROGRAM TERMS AND CONDITIONS

Welcome to the Shahkaar Affiliate Program.

These Affiliate Program Terms and Conditions (“Terms”) govern participation in the affiliate program operated by Shahkaar Fashions Private Limited, trading under the brand name Shahkaar (“Shahkaar,” “we,” “us,” or “our”).

Any individual, company, publisher, influencer, content creator, agency, or other entity participating in the Affiliate Program is referred to as an “Affiliate,” “you,” or “your.”

By applying for, accessing, or participating in the Affiliate Program, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms in their entirety, you must not register for or participate in the Affiliate Program.

1. Eligibility and Registration

To participate in the Affiliate Program, you must:

  1. Be at least 18 years old and legally capable of entering into a binding agreement;

  2. Provide complete, accurate, and current registration, identity, tax, payment, website, and promotional-channel information;

  3. Own, control, or be duly authorized to use every website, social-media account, application, newsletter, or other channel through which you intend to promote Shahkaar;

  4. Comply with all applicable laws, regulations, advertising standards, platform policies, and these Terms; and

  5. Not have previously been suspended or removed from the Affiliate Program unless Shahkaar has expressly authorized your participation again in writing.

You must promptly update your account if any information supplied during registration changes.

You are responsible for maintaining the confidentiality and security of your Affiliate Program account. Activity conducted through your account will be treated as activity undertaken by you unless you notify us promptly of unauthorized access.

2. Approval or Rejection of Applications

Submission of an application does not guarantee acceptance into the Affiliate Program.

Shahkaar may approve, reject, place on hold, or request further information regarding any application at its sole discretion. We are not required to provide a reason for rejecting an application.

Approval applies only to the Affiliate and promotional channels disclosed in the application. You must obtain our prior written approval before materially changing your promotional methods or using additional websites, accounts, applications, advertising networks, or other channels.

Approval of an Affiliate does not constitute an endorsement by Shahkaar of the Affiliate or the Affiliate’s content.

3. Affiliate Links and Coupon Codes

Once approved, you may receive access to:

  • A unique affiliate link;

  • Links to specific products, collections, or pages;

  • A unique coupon or promotional code; and/or

  • Approved banners, photographs, text, logos, and other promotional materials.

You must use only the tracking links, codes, and materials issued or expressly approved by Shahkaar.

Coupon codes may be subject to product, customer, territory, minimum-order, expiry, sale, or other restrictions. These restrictions may be displayed in your affiliate dashboard, Affiliate Guide, or campaign instructions.

You must not:

  1. Promote a coupon code that has not been assigned or expressly approved for your use;

  2. Alter, conceal, misspell, or misrepresent a coupon code;

  3. Present a publicly available Shahkaar discount code as an exclusive Affiliate offer;

  4. Publish expired, unauthorized, leaked, or fabricated coupons;

  5. Submit your code to coupon, cashback, deal, or voucher websites without prior written approval;

  6. Encourage customers to cancel and reorder solely to obtain Affiliate attribution; or

  7. Claim that your link or code provides the “best,” “highest,” or “exclusive” discount unless Shahkaar has confirmed this in writing.

Where a customer uses both an Affiliate link and a coupon code, only one commission will be payable. There will be no duplicate commission for the same order.

4. Attribution and Tracking

Affiliate attribution is determined exclusively by Shahkaar’s tracking system and Affiliate Program platform.

Unless otherwise stated in the affiliate dashboard or applicable campaign terms, attribution may be based on the most recent eligible Affiliate interaction within the applicable tracking period.

The applicable cookie or tracking period will be stated in the registration form, affiliate dashboard, Affiliate Guide, or campaign details.

Tracking depends on factors including cookies, browser settings, device configuration, consent preferences, ad blockers, technical compatibility, and the customer’s subsequent actions. Shahkaar does not guarantee that every visit or order will be tracked.

No commission will be payable where:

  • Cookies or tracking technologies are rejected, deleted, blocked, or unavailable;

  • The customer changes devices, browsers, or sessions and attribution is lost;

  • The Affiliate link or code is incorrectly used;

  • The order cannot be reliably attributed to the Affiliate;

  • Another eligible Affiliate receives attribution under the applicable tracking rules;

  • The customer uses an unauthorized coupon or promotional method;

  • Tracking has been manipulated or interfered with; or

  • The referral originates from prohibited traffic.

Shahkaar’s tracking records and attribution decisions will be final, except in the case of a clear and demonstrable technical error.

5. Commission Eligibility

An Affiliate may earn commission only on an eligible order that:

  1. Is placed on an official Shahkaar website through an eligible Affiliate referral;

  2. Is successfully paid for;

  3. Is accepted, processed, and fulfilled by Shahkaar;

  4. Is not cancelled, refunded, returned, disputed, charged back, fraudulent, duplicated, or otherwise reversed;

  5. Is placed by a genuine third-party customer for legitimate personal or business use;

  6. Complies with these Terms and the applicable campaign conditions; and

  7. Has completed the applicable validation, return, and chargeback period.

The commission rate and structure applicable to you will be displayed in the affiliate dashboard, Affiliate Guide, or written campaign offer.

Unless expressly stated otherwise, commission is calculated on the net eligible product value actually retained by Shahkaar, after deducting:

  • Discounts and coupon reductions;

  • Returns and refunds;

  • Cancellations and chargebacks;

  • Taxes, GST, VAT, customs duties, and similar government charges;

  • Shipping, delivery, insurance, and handling charges;

  • Gift cards, store credit, or loyalty points used;

  • Payment-processing or marketplace adjustments, where applicable; and

  • Any other amount not forming part of the net product revenue retained by Shahkaar.

Commission is not earned merely because it appears as pending, tracked, or estimated in the affiliate dashboard.

6. Commission Review, Reversal, and Withholding

All referrals and commissions are subject to review and validation.

Shahkaar may reject, reverse, cancel, withhold, offset, or recover commission connected with:

  • A cancelled, returned, refunded, or partially refunded order;

  • A payment dispute, chargeback, or fraudulent transaction;

  • A self-referral or related-party order;

  • Duplicate orders or duplicate attribution;

  • An order placed for resale where the applicable campaign does not permit it;

  • Unauthorized paid advertising;

  • Misleading, deceptive, or unlawful promotion;

  • Cookie stuffing, click injection, forced clicks, or tracking manipulation;

  • Use of an unauthorized coupon;

  • Abuse of Shahkaar’s return, discount, payment, or shipping policies;

  • An Affiliate’s breach of these Terms; or

  • Any transaction that Shahkaar reasonably believes is artificial, collusive, suspicious, or not generated through genuine customer interest.

Where commission has already been paid on an ineligible order, Shahkaar may deduct the amount from future payments or request repayment.

The fair-use policy allows Shahkaar to review every referral and order before approving commission.

7. Payments

To receive payment, you must provide complete and accurate payment, bank, identity, and tax information in the affiliate dashboard.

The payment schedule, minimum payout threshold, supported payment methods, and applicable currency will be stated in the affiliate dashboard or Affiliate Guide.

Payments will be made only after:

  • The commission has been approved;

  • The applicable validation and return period has expired;

  • The minimum payout threshold has been reached;

  • Required tax and payment documentation has been received; and

  • There is no pending investigation or suspected violation.

You are responsible for:

  • All taxes arising from commission received;

  • Providing legally required invoices or tax documentation, where applicable;

  • Payment-provider, intermediary-bank, foreign-exchange, or receiving-bank charges; and

  • Ensuring that your payment details remain accurate.

Shahkaar may deduct or withhold taxes where required by law. Shahkaar will not be responsible for payments delayed, rejected, or lost because of incorrect or incomplete information supplied by the Affiliate.

8. Strict Prohibition on Google Ads and Paid Search Traffic

Affiliates are strictly prohibited from using Google Ads to advertise, promote, redirect to, or generate traffic for Shahkaar, any Shahkaar product, any Shahkaar website, or any Affiliate link or coupon code.

This prohibition applies to all Google advertising formats, including:

  • Google Search Ads;

  • Google Shopping Ads;

  • Google Display Network advertisements;

  • Performance Max campaigns;

  • YouTube advertisements;

  • Discovery or Demand Gen campaigns;

  • Gmail advertisements;

  • Google remarketing or retargeting;

  • App-install or in-app campaigns; and

  • Any other advertising product owned, operated, distributed, or syndicated by Google.

Affiliates must not:

  1. Bid on “Shahkaar,” “Shahkaar Kashmir,” “shahkaar.com,” “shahkaar.in,” any misspelling, variation, translation, trademark, product name, collection name, or branded search term associated with Shahkaar;

  2. Bid on terms combining a Shahkaar brand term with words such as “coupon,” “discount,” “sale,” “review,” “official,” “cashmere,” “pashmina,” “shawl,” or similar commercial terms;

  3. Use Shahkaar’s name, trademarks, domain names, product names, or confusingly similar wording in ad copy, display URLs, keywords, account names, or landing-page domains;

  4. Direct paid advertisements to a Shahkaar website, Affiliate link, redirecting page, bridge page, coupon page, or any page primarily designed to forward visitors to Shahkaar;

  5. Use negative-keyword strategies, broad matching, automated bidding, or dynamic keyword insertion in a manner that may cause an advertisement to appear for a Shahkaar-branded search;

  6. Circumvent this restriction through another advertising account, agency, sub-affiliate, influencer, publisher, redirect, shortened URL, or third party; or

  7. Use Google Ads even if the Affiliate believes the campaign targets only generic or non-branded keywords.

Google Ads referrals are subject to automatic denial. No commission will be payable for orders or traffic attributed directly or indirectly to Google Ads.

A violation may result in immediate commission cancellation, suspension, or permanent removal from the Affiliate Program.

9. Other Paid Advertising

Unless Shahkaar provides prior written approval, Affiliates must not use paid advertising on any search engine, social-media platform, advertising network, marketplace, comparison-shopping service, native-advertising platform, or other paid traffic source to promote Shahkaar.

This includes paid advertising through Bing/Microsoft Ads, Meta Ads, Instagram Ads, Facebook Ads, TikTok Ads, Pinterest Ads, Amazon Ads, influencer-whitelisting campaigns, sponsored-content networks, and similar services.

Any written approval may contain campaign-specific restrictions. Shahkaar may withdraw such approval at any time.

Organic social-media content, genuine editorial content, unpaid reviews, and lawful search-engine-optimized content are permitted, subject to these Terms.

10. Permitted Promotional Methods

Subject to these Terms, approved Affiliates may promote Shahkaar through:

  • Original editorial articles and blog posts;

  • Genuine product reviews;

  • Organic social-media posts;

  • Videos and other original content;

  • Email newsletters sent to recipients who have lawfully opted in;

  • Approved offline publications;

  • Approved influencer content; and

  • Other methods expressly authorized by Shahkaar.

All promotional content must be truthful, accurate, professional, and consistent with Shahkaar’s premium brand positioning.

11. Prohibited Conduct and Traffic

Affiliates must not engage in or facilitate:

  1. Self-referrals, including purchases made by the Affiliate or on the Affiliate’s behalf;

  2. Orders placed by employees, agents, household members, or closely related parties for the primary purpose of earning commission;

  3. Fraudulent, automated, incentivized, bot-generated, or non-human traffic;

  4. Cookie stuffing, cookie dropping, click injection, forced clicks, hidden links, pop-unders, toolbars, browser extensions, adware, spyware, malware, or similar technologies;

  5. Automatic redirects or links activated without a genuine, informed user action;

  6. Misleading buttons, fake notifications, fake urgency, or deceptive calls to action;

  7. Spam, unsolicited bulk email, unsolicited messages, or unlawful telemarketing;

  8. Domain names, social-media handles, applications, pages, or accounts containing “Shahkaar,” a Shahkaar trademark, or a confusingly similar term;

  9. Impersonating Shahkaar or suggesting that an Affiliate channel is an official Shahkaar website or account;

  10. False, exaggerated, unsubstantiated, or misleading product claims;

  11. Misrepresentation of product composition, origin, craftsmanship, certification, availability, price, discount, delivery time, or return eligibility;

  12. Altering Shahkaar product images in a way that misrepresents colour, design, dimensions, texture, workmanship, or appearance;

  13. Promoting Shahkaar through illegal, hateful, violent, sexually explicit, discriminatory, defamatory, politically extremist, or otherwise unsuitable content;

  14. Promoting on websites or channels involving piracy, counterfeit goods, unlawful gambling, or infringement of intellectual-property rights;

  15. Generating fake reviews, fake followers, fake engagement, or fabricated testimonials;

  16. Purchasing products using stolen or unauthorized payment information;

  17. Interfering with Shahkaar’s website, tracking system, checkout, customer data, or security;

  18. Scraping or collecting customer information without authorization;

  19. Offering cashback, rewards, rebates, donations, incentives, or revenue sharing from Affiliate commission without written approval;

  20. Submitting Affiliate links or codes to browser extensions, coupon injectors, AI shopping assistants, or similar tools without written approval; or

  21. Using any technique whose primary purpose is to capture commission from a customer who was already intending to purchase directly from Shahkaar.

12. Affiliate Disclosures and Advertising Compliance

Affiliates must clearly and conspicuously disclose their commercial relationship with Shahkaar whenever promoting Shahkaar.

A disclosure must:

  • Be placed close to the endorsement or Affiliate link;

  • Be visible before or at the time the customer views the promotional claim;

  • Be understandable to the intended audience;

  • Not be hidden behind a link, “more” button, profile page, or lengthy group of hashtags; and

  • Comply with all applicable laws, regulations, and platform rules.

Appropriate disclosures may include:

  • “I may earn a commission if you purchase through this link.”

  • “Affiliate link.”

  • “Paid partnership with Shahkaar.”

  • “Advertisement” or “Ad,” where appropriate.

Affiliates targeting customers in India must comply with applicable Indian advertising and consumer-protection requirements, including applicable influencer-advertising disclosure standards. Affiliates targeting customers in other jurisdictions must also comply with the laws and disclosure requirements applicable there.

The Affiliate is solely responsible for ensuring that all promotions and disclosures comply with applicable law.

13. Truthful Endorsements and Product Claims

Any statement about Shahkaar or its products must reflect the Affiliate’s honest opinion and actual experience.

Affiliates must not:

  • Make claims that are false, misleading, or not supported by information supplied by Shahkaar;

  • Claim to have used or inspected a product if they have not done so;

  • Describe a product as GI-certified, government-certified, handspun, handmade, handwoven, hand-embroidered, pure Pashmina, Cashmere, limited edition, or one-of-a-kind unless the specific product is accurately described that way by Shahkaar;

  • Guarantee results, investment value, appreciation, delivery dates, customs clearance, or product availability;

  • Make claims that contradict the product listing, care instructions, certification terms, shipping policy, or return policy; or

  • Present personal opinion as an official statement from Shahkaar.

If you become aware that previously published information is inaccurate or outdated, you must promptly correct or remove it.

14. Intellectual Property and Brand Use

Shahkaar retains all rights, title, and interest in its trademarks, trade names, logos, product photographs, videos, text, designs, website content, promotional materials, and other intellectual property.

While you remain an approved Affiliate, Shahkaar grants you a limited, non-exclusive, non-transferable, revocable, royalty-free licence to use approved promotional materials solely to promote Shahkaar in accordance with these Terms.

You must not:

  • Modify Shahkaar’s logo or trademarks without written approval;

  • Claim ownership of Shahkaar content;

  • Register or use Shahkaar’s trademarks in a domain, company name, application name, account handle, keyword, metatag, or advertising account;

  • Use Shahkaar’s content for purposes unrelated to the Affiliate Program;

  • Sell, sublicense, distribute, or provide Shahkaar materials to third parties;

  • Remove copyright, trademark, watermark, or attribution notices; or

  • Create confusingly similar branding.

Upon suspension or termination, you must immediately stop using Shahkaar’s intellectual property and remove Affiliate links, coupon codes, and promotional materials.

15. Email, Messaging, and Privacy Compliance

Affiliates may send promotional emails or messages only to recipients who have validly consented to receive them.

Affiliates must comply with all applicable privacy, data-protection, anti-spam, telemarketing, and electronic-communications laws.

Affiliates must not:

  • Send unsolicited commercial messages;

  • Purchase or use unlawfully obtained mailing lists;

  • Represent that an email or message was sent by Shahkaar;

  • Use a misleading sender name, subject line, or reply address;

  • Collect or process Shahkaar customer information without authorization; or

  • share personal data with Shahkaar unless lawfully collected and necessary for the Affiliate Program.

You are independently responsible for any personal information collected through your websites or promotional channels.

16. Marketing Materials

Shahkaar may provide banners, logos, photographs, videos, product descriptions, campaign materials, or embed codes through the affiliate dashboard or by other means.

You may use these materials only:

  • During your active participation in the Affiliate Program;

  • For approved Affiliate promotion;

  • Without misleading alterations; and

  • In accordance with any accompanying campaign or brand guidelines.

Shahkaar may require you to modify or remove any promotional content. You must comply promptly and, in any event, within 48 hours of receiving the request.

17. Affiliate Network and Sub-Affiliates

Where the Affiliate Program enables a network or downline feature, you may invite others to apply using your network link.

A person becomes your downline Affiliate only after completing registration and being approved under the applicable program process.

Network commission, if offered, will be calculated according to the settings shown in the affiliate dashboard.

You must not:

  • Guarantee approval, income, sales, or commission to prospective Affiliates;

  • Charge a fee to join the Shahkaar Affiliate Program;

  • Create a pyramid, recruitment, or investment scheme;

  • Misrepresent the Affiliate Program as employment, a franchise, or a guaranteed business opportunity; or

  • Operate sub-affiliate campaigns outside the approved network feature without written permission.

Shahkaar may reject, suspend, remove, or reassign a downline Affiliate and may reverse network commissions connected with an ineligible or prohibited referral.

18. Monitoring and Audit Rights

Shahkaar may monitor Affiliate websites, advertisements, content, traffic sources, coupon usage, referrals, and transactions to verify compliance.

Upon request, you must provide reasonable evidence regarding:

  • Traffic sources;

  • Advertising accounts and campaign reports;

  • Referring URLs;

  • Audience and engagement data;

  • Promotional content;

  • Email-consent records;

  • Sub-affiliate activity; and

  • Any other information reasonably required to investigate compliance.

Failure to provide requested information may result in commission withholding, suspension, or termination.

19. Suspension and Termination

Either party may terminate participation in the Affiliate Program at any time by providing notice.

Shahkaar may immediately suspend or terminate an Affiliate, disable links or codes, and withhold disputed commission where Shahkaar reasonably believes that the Affiliate has:

  • Breached these Terms;

  • Used prohibited traffic, including Google Ads;

  • Engaged in fraud, abuse, manipulation, or unlawful conduct;

  • Harmed or risked harming Shahkaar’s brand or reputation;

  • Failed to provide requested verification;

  • Supplied false or incomplete information;

  • Remained inactive for an extended period; or

  • Created legal, regulatory, financial, or security risk.

Termination does not affect rights or liabilities that arose before termination.

Valid commission approved before termination may remain payable according to the regular payment schedule. However, no commission will be payable on fraudulent, prohibited, reversed, or non-compliant transactions.

20. Independent Contractor Relationship

The Affiliate is an independent contractor.

Nothing in these Terms creates an employment, partnership, joint venture, franchise, agency, fiduciary, sales-representative, or exclusive relationship between the Affiliate and Shahkaar.

You have no authority to:

  • Enter into any agreement on behalf of Shahkaar;

  • Make commitments or warranties for Shahkaar;

  • Collect money on Shahkaar’s behalf;

  • Provide refunds or customer-service decisions on Shahkaar’s behalf; or

  • Represent that you are an employee, authorized representative, or agent of Shahkaar.

21. Confidentiality

Information identified as confidential, or which should reasonably be understood to be confidential, must not be disclosed or used outside the Affiliate Program.

Confidential information may include unpublished commission rates, customer information, campaign plans, commercial terms, unreleased products, conversion data, internal communications, security information, and non-public business information.

This obligation survives termination of your Affiliate participation.

22. Disclaimer of Warranties

The Affiliate Program, tracking system, links, dashboard, promotional materials, and related services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Shahkaar does not guarantee:

  • Continuous or error-free operation;

  • Any minimum traffic, sales, conversion, or commission;

  • Accurate tracking in every circumstance;

  • Continued availability of any product, discount, campaign, market, or website;

  • Acceptance of every customer order; or

  • Continued operation of the Affiliate Program.

Shahkaar may modify, suspend, or discontinue any aspect of the Affiliate Program.

23. Limitation of Liability

To the maximum extent permitted by law, Shahkaar will not be liable for indirect, incidental, special, punitive, exemplary, or consequential loss, including loss of profit, revenue, data, goodwill, opportunity, or anticipated commission.

Shahkaar’s total aggregate liability arising from the Affiliate Program will not exceed the total valid commission paid or payable to the Affiliate during the six months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

24. Indemnification

You agree to indemnify, defend, and hold harmless Shahkaar, Shahkaar Fashions Private Limited, and their directors, officers, employees, representatives, and agents from claims, losses, liabilities, penalties, damages, costs, and reasonable legal expenses arising out of or relating to:

  • Your promotional activity;

  • Your breach of these Terms;

  • Your violation of applicable law or third-party rights;

  • Your content, claims, websites, advertisements, or communications;

  • Your misuse of Shahkaar’s intellectual property;

  • Your collection or processing of personal data; or

  • Fraudulent, negligent, or wilful conduct by you or anyone acting on your behalf.

25. Changes to the Program or These Terms

Shahkaar may update these Terms, commission structures, tracking rules, campaign conditions, payment schedules, or Program features.

Material changes will be communicated through the affiliate dashboard, by email, or by publication on the applicable Shahkaar website.

Unless otherwise stated, changes apply prospectively from the effective date shown in the updated Terms. Continued participation after the effective date constitutes acceptance of the updated Terms.

If you do not agree to an update, you must stop participating in the Affiliate Program.

26. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.

The parties will first attempt in good faith to resolve any dispute through written discussions. A party raising a dispute must provide written notice describing the issue, and the parties will have 30 days to attempt an amicable resolution.

If the dispute cannot be resolved, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996, as amended. The arbitration will be conducted by a sole arbitrator mutually appointed by the parties. If the parties cannot agree on an arbitrator, the arbitrator will be appointed in accordance with the Act.

The seat and venue of arbitration will be Srinagar, Jammu and Kashmir, India, and the proceedings will be conducted in English.

Subject to the arbitration provision, courts having jurisdiction in Srinagar, Jammu and Kashmir, India, will have exclusive jurisdiction.

27. General Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

Failure by Shahkaar to enforce a provision does not waive its right to enforce that provision later.

You may not transfer, assign, sublicense, or delegate your rights or obligations under these Terms without Shahkaar’s prior written consent. Shahkaar may assign these Terms as part of a restructuring, merger, acquisition, business transfer, or transfer of the Affiliate Program.

These Terms, together with applicable campaign terms, Affiliate Guides, dashboard settings, and written approvals, constitute the entire agreement concerning participation in the Affiliate Program.

If campaign-specific written terms conflict with these general Terms, the campaign-specific terms will apply only to that campaign. However, the prohibition on Google Ads will continue to apply unless Shahkaar expressly states otherwise in writing.

Headings are for convenience only and do not affect interpretation.

Provisions concerning commission reversals, intellectual property, confidentiality, indemnification, limitation of liability, governing law, dispute resolution, and accrued obligations survive termination.

Privacy Policy

Full bank or payment details may be collected directly by a payment provider or affiliate platform. Shahkaar may receive only the information necessary to initiate, verify, record, or reconcile payments.

  • Eligible order value;

  • Suspected fraudulent or prohibited activity.

3. Information Collected About Customers and Website Visitors

When a person clicks an Affiliate link, uses an Affiliate coupon code, visits a Shahkaar website, or makes a purchase, we and our service providers may collect information needed to track and validate the referral.

This may include:

  • Affiliate or referral identifier;

  • Cookie or device identifier;

  • IP address;

  • Browser and device information;

  • Referring page or URL;

  • Landing page;

  • Date and time of the visit;

  • Pages or products viewed;

  • Coupon code used;

  • Order ID;

  • Discount amount;

  • Shipping, tax, or duty amount where relevant to commission calculation;

Shahkaar does not provide Affiliates with customers’ full payment-card information.

Affiliates generally receive only the information available through their affiliate dashboard, such as referral status, order value, products, commission, and order identifiers. Customer personal information will not be disclosed to an Affiliate unless necessary and legally permitted.

4. Information Collected From Shopify and Other Commerce Platforms

Because the Affiliate Program is connected to Shahkaar’s e-commerce operations, our affiliate platform may receive certain information from Shopify or another commerce platform.

Depending on the permissions and features enabled, this may include:

  • Shahkaar store name and domain;

  • Store currency, language, and country;

  • Product and collection information;

  • Order and transaction information;

  • Discount and coupon information;

  • Return, refund, and cancellation information;

  • Customer or visitor identifiers;

  • Affiliate-attribution information; and

  • Information necessary to install, operate, troubleshoot, secure, or remove the affiliate application.

Such information is used only for legitimate operational, contractual, legal, security, and Affiliate Program purposes.

The Affiliate Program may use:

  • Coupon-code attribution;

  • Device or browser identifiers; and

  • Server-side transaction records.

  • Identify the Affiliate responsible for a referral;

  • Maintain attribution during the applicable tracking period;

  • Measure Affiliate Program performance;

  • Prevent duplicate attribution;

  • Detect fraud, abuse, and prohibited advertising;

  • Apply a coupon code;

  • Verify commission eligibility;

  • Maintain security; and

  • Improve the Affiliate Program.

The duration of an Affiliate tracking cookie may be stated in the Affiliate registration form, affiliate dashboard, Affiliate Guide, Cookie Policy, or campaign terms.

You may block or delete cookies through your browser settings or applicable consent tools. However, if tracking technologies are blocked, rejected, deleted, or unavailable, we may be unable to attribute an order to an Affiliate.

Where legally required, non-essential cookies or similar technologies will be used only after obtaining the required consent.

6. Google Ads and Prohibited-Traffic Detection

The Shahkaar Affiliate Program prohibits Affiliates from generating traffic through Google Ads, as further described in the Affiliate Program Terms and Conditions.

To enforce this restriction, we and our service providers may process information such as:

  • Referring URLs;

  • Campaign parameters;

  • Click identifiers;

  • UTM parameters;

  • Source and medium information;

  • Landing pages;

  • Redirect chains;

  • IP and device information;

  • Order-attribution records;

  • Coupon usage;

  • Traffic patterns;

  • Advertising-network indicators; and

  • Other technical or transactional information that may indicate prohibited paid advertising.

The affiliate platform may automatically identify and deny referrals believed to have originated directly or indirectly from Google Ads or another prohibited traffic source.

An automatically denied referral will not generate an approved commission unless Shahkaar determines, following review, that the referral was incorrectly classified.

If you believe a referral has been wrongly denied, you may contact info@shahkaar.com and provide relevant supporting information. We may request campaign reports, traffic-source records, referring URLs, screenshots, or other evidence necessary to review the referral.

We may continue to retain information connected with prohibited traffic where reasonably necessary to:

  • Investigate a violation;

  • Prevent repeat abuse;

  • Defend or enforce contractual rights;

  • Maintain accurate commission records;

  • Comply with legal obligations; or

  • Protect Shahkaar, its customers, and the Affiliate Program.

  • Creating and administering Affiliate accounts;

  • Generating Affiliate links and coupon codes;

  • Providing the affiliate dashboard;

  • Calculating and paying commission;

  • Communicating campaign information;

  • Reviewing Affiliate activity;

  • Confirming traffic sources;

  • Enforcing Affiliate Program Terms and Conditions;

  • Detecting Google Ads and other prohibited traffic;

  • Preventing self-referrals, duplicate attribution, cookie stuffing, or manipulation;

  • Detecting fraud, abuse, cyber threats, and suspicious transactions;

  • Suspending or terminating non-compliant accounts.

  • Validating commission;

  • Processing payouts;

  • Issuing or receiving invoices;

  • Reconciling payments;

  • Applying withholding taxes;

You may unsubscribe from optional marketing communications, but you may continue to receive essential Affiliate Program, transaction, compliance, legal, or security communications.

This includes:

  • Measuring Affiliate and campaign performance;

  • Understanding referral patterns;

  • Troubleshooting technical issues;

  • Improving tracking and attribution;

  • Evaluating program effectiveness;

  • Developing new Affiliate Program features; and

  • Complying with law, regulation, court orders, and lawful government requests;

  • Establishing, exercising, or defending legal claims;

  • Complying with cookie and tracking requirements;

  • Protecting the information collected;

  • Responding to privacy requests;

  • Complying with anti-spam and direct-marketing laws; and

  • Ensuring that personal information is lawfully shared with Shahkaar.

Affiliates must not:

  • Collect personal information while falsely representing themselves as Shahkaar;

  • Collect payment-card information on Shahkaar’s behalf;

  • provide Shahkaar with unlawfully obtained customer lists;

  • Use Shahkaar customer information for independent marketing;

  • Scrape customer information from Shahkaar websites;

  • Attempt to identify customers from aggregated Affiliate reports; or

  • Share Affiliate dashboard information containing customer data with unauthorized parties.

If an Affiliate receives personal information from Shahkaar, the Affiliate must use it only for the authorized purpose, maintain appropriate security, and delete it when no longer required.

11. International Data Transfers

Shahkaar is based in India, but our service providers, Affiliates, customers, and technical infrastructure may be located in other countries.

As a result, personal information may be processed or stored outside the country where it was originally collected. Those countries may have privacy laws different from the laws of your country.

Where required, we will use appropriate contractual, organizational, or legal safeguards for international transfers. Transfers will also remain subject to any restrictions imposed under applicable Indian data-protection law.
