Please read this marketing affiliate program agreement carefully.
Eligibility: Must be an active coach or a Kinetic Arm customer that has purchased and or is currently using the Kinetic Arm.
Athletic Programs/Facilities, Coaches, and Medical Professionals may apply to become a Kinetic Arm Affiliate Location.
These following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or "Company”) and an affiliate (“you” or “affiliate”) who refers customers to use product or service from the merchant.
By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Program in any manner.
1. Approval or Rejection of the Affiliate Registration
Company reserves the right to withhold or refuse approval as an Affiliate for any reason. Company can approve or reject any Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.
This agreement does not create an exclusive agreement between you and us. Once you complete the registration form, we will review your application and notify you whether you have been accepted to particpate in the Kinetic Arm Affiliate program, or not.
As the Company we reserve the right to reject or terminate any application for any reason whatsoever, even after acceptance, at owners absolute discretion. If we do not notify you that you are accepted to partipate in the KA Affiliate program within 30 days from your application, your application is considered to be rejected.
Your acceptance and particpation in the KA Affiliate program does not mean you are accepted as a partner or sponsorship. Your membership will be terminated if you misrepresent or embellish our relationship with you (including by expressing or implying that we support, sponsor, or endorse you), or express or imply any affiliation between us and you or any other person or entity except as expressly permitted by this Agreement.
Once you have been approved, your continued right to particpate is conditioned upon the ongoing compliance with the terms and conditions of this Agreementl. Failure of the Affiliate to observe the terms and conditions of this Agreement will disqualify Affiliate from participating in the program.
2. Affiliate Disclosures
The Federal Trade Commission (FTC) mandates all promotional posts to include affiliate link disclosures. This applies to website owners, social media influencers, bloggers, and all affiliate program partners. You must clearly and prominently identiy yourself as an affiliate on any digital marketing platform. Endorsements without affiliate disclosures are agains the law and are legal liabilities. Affiliate disclosures let customers understand affiliate relationships and identify paid and unpaid endorsements to make better purchasing decisions.
Once approved you will have access to Affiliate Disclosure templates that we authorize to display or use with content, as required by applicable law.
3. Links and Coupon
Affiliate link is automatically generated, but you can request to customize your discount code - you will also receive an automated generated affiliate link. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.
Affiliate might or might not be assigned to one coupon code with details and usage clarified on Dashboard. If customer both click on the affiliate link and use coupon code, you will not receive a double commission. If you’re not assigned a branded coupon, then you’re not allowed to promote the coupon.
Affiliate Discount Code Usage Policy:
As a valued affiliate partner of the Kinetic Arm, we appreciate your dedication to promoting our brand and products. To ensure consistency in our marketing efforts and to maintain the integrity of our brand identity, we have established the following policy regarding the use of affiliate discount codes on our company-owned platforms, including by not limited to social media ads, official website, and marketing materials.
- Prohibited Used on Company-Owned Platforms: Affiliates are prohibited from posting their personal discount codes or affiliate-specific promotions on any company-owned platforms, including social media ads, official website pages, blog posts, and marketing materials without explicity written consent from the company.
- Brand Consistency: We strive to maintain a consistent brand image and messaging across all marketing channels. Posting affiliate discount codes on a company-owned platforms may undermine our efforts to communicate a unified brand message and could potentially confuse or mislead customers.
- Authorized Promotion Channels: Affiliates are encouraged to promote their discount links and codes through their own channels, including social media profiles, blogs, newsletters, and other digital platforms where they have a presence. This allows affiliates to engage with their audience in a manner that is consistent with their personal brand while driving traffic and sales to the company.
- Compliance with Terms: By participating in the Kinetic Arm affiliate program, affiliates agree to abide by this discount code usage policy. Failure to comply with these terms may result in termination of the affiliate partnership and forfeiture of any pending commissions.
- Modification Policy: The company reserves the right to modify or update this discount code usage policy at any time without prior notices.
Important: We recommend always including a disclosure statement even if your country doesnt have affiliate regulations. Seek professional legal advice, if you are unsrue about your country's affiliate law.
Anti-Spam Policy. As a Kinetic Arm marketing affiliate you may not place affiliate links to the Kinetic Arm website content in newsgroups, message boards, unsolicited email and other types of spam, banner networks, counters, chat rooms, guest books, IRC channels or through similar internet resources.
We strictly forbid the use of unsolicited commercial email (UCE) or SPAM campaigns, if direct, third party, or any affiliate or person acting on affiliates behalf. As such, Kinetic Arm reserves the right to terminate any violating affiliate account or any part thereof, without notice or compensation.
4. Affiliate Discount Codes/Links on Gently Used Discount or Clearance Items:
Affiliate discount codes/links are promotional tools provided to Kinetic Arm affiliates to offer discounts on eligible products on website. Affiliate discount codes/links can only be redeemed for purchases of new, non-discounted items on the website unless otherwise specified in the terms of the specific code. Gently-used gear discount items cannot be purchased using affiliate discount codes or links.
Gently-used discount or clearance items are excluded from any affiliate promotions, discounts, or offers. The Kinetic Arm reserves the right to refuse the use of affiliate codes on any purchase made on the company's website. These terms specifically address the inapplicability of Codes to gently-used gear discount items.
- Gently-used discount items refer to products llisted on the website that are sold at a discounted price due to being previously owned or gently used.
- These items are clearly marked on the website product pages. These items are already offered at a reduced price due to their pre-owned or gently-used nature and are not eligible for further discounts through affiliate codes or links.
5. Commissions and payment
Refer any customer to make a purchase on our website, you will get a commission amount which is calculated based on Commission structure. Commission amount is dependent on order value and not including extra fee (tax, shipping cost...).
To be eligible for Commission an affiliate must be accepted by the company and using customized tracking link. For an Affiliate to receive a commission, you need to specify PayPal payment details in Settings. Payment schedule will be notified on Affiliate Guide page.
Payments will only be sent for transactions that have been successfully completed. Use of the Affiliate Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission if displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.
You will only be eligible for a commission payment for any customer transactions that derived from affiliate leads generated by the afiliate link that we make available to you on your Affiliate Dashboard. If the affiliate lead is not valid then we may choose to maintain it in our database and engage with affiliate lead at our discretion. If the commission payment has been obtained by fraudulent means, or if there is a misuse of the Affiliate Link, the affiliate will be notified there was a violation of program policies in breach of commission agreement.
6. Affiliate Commission Payments and Tax Reporting: As a participant in the Kinetic Arm affiliate program, it is important to understand the process for receiving commission payments and fulfilling tax reporting requirements. By joining our affiliate program you agree to adhere to the following terms and conditions:
- Commission Payments: Affiliate commissions are typically paid out on a monthly basis, subject to reaching the minimum payout threshold as specified in this affiliate agreement. Commission paymetns are made via PayPal.
- Tax Reporting Obligations: Affiliates are responsible for accurately reporting all commission income earned through the Kinetic Arm affiliate program to the relevant tax authorities in their jurisdiction. This includes filing any required tax forms and reporting income on their annual tax return.
- W9 Form Requirement: In order to receive commission payments from the company, affiliates based in the United States are required to complete and submit a form W9 to certifiy their taxpayer identification number (TIN) and legal name for tax reporting purposes.
- Submission Deadline: Affiliates must submit a completed and signed Form W9 to the company within 30 days of joining the Kinetic Arm affiliate program, or receiving request and or reaching minumum payout threshold, whichever comes first. Failure to submit a valid W9 form may result in delayed or withheld commission payments.
- Information Accuracy: Affiliates must ensure that all information provided on the W9 form is accurate and up to date. Any changes to the informaiton provided (e.g. legal name / TIN) must be promptly communicated to the company by submitting an updated W9 form.
- Privacy and Confidentiality: The information provided on the W9 form will be used soley for tax reporting purposes and will be treated with the utmost confidentiality in accordance with our privacy policy. The Perfect Arm LLC, Kinetic Arm company will not discolose or share this information with any third parties except as required by law.
- Non-Compliance: Failure to comply with the W9 form requirement or providing inaccrate or incomplete information may result in the suspension or termination of the affiliate's account and forfeiture of any outstanding commissions.
7. Marketing tools
As a Kinetic Arm affiliate you grant to us a nonexclusive, nontransferable, royalty free right to use and display your content in connection with our products in the use of our Affiliate Program and this agreement.
If you wish to use Kinetic Arm promotional media such as logo or specific collection promotions that are available to you on your account dashboard you must comply with our Content Usage Guidelines. You can download our media or get the HTML embed code in the Marketing Tools tab in order to share to your affiliate channels.
The Perfect Arm LLC, (Kinetic Arm) reserves the right to repurpose any content produced or created and used by KA Affiliates for marketing purposes.
The Kinetic Arm products are protected by intellectual property laws. The Kinetic Arm products belong to and are the property of us and or licensors (if any). We retail all ownership rights in the Kinetic Arm products and media.
8. Kinetic Arm Content Usage
Feel free to share links to any of our content by email and social media. You can also republish any Kinetic Arm images, videos, or graphics and include them in your content as long as you honor the Content Attribution Policy below.
Unfortunately, we cannot let you republish in full any of our text-based content (blog articles, PDF's, Docs, PPT) on the web.

9. Network
If Network tab is activated, affiliate can invite others to become their downline affiliate. If any downline affiliate brings order to merchant shop, upline affiliate will also get network commission which depends on merchant settings.
To invite other affiliates into the system, share network link and any other affiliate who click on that link and sign up will become a downline affiliate.
10. Cookies
We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.
If a person doesn't allow cookies or clears their cookies then we can't track them so can't pay earnings on that person's activity.
Cookies day is said on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the affiliate (There’s no need for the customer to click on the affiliate link then).
11. Removal from Referral Program
The Perfect Arm LLC as the "merchant" may choose to periodically uptate or replace these terms in their entirety. If we update or replace terms we will let you know via electornic means, such as a nofication email. If for any reason you do not agree to the updates or replacement terms you can choose to terminate your agreement by emailing us at sales@thekineticarm.com.
Termination Without Cause: Both you and we may terminate this agreement at any time, for any reason, by just notifiying the other party.
Profanity is prohibited. Any profane language including but not limited to racial, ethnic, or sexual slurs in music lyrics, content, or comments which could be considered repulsive, obscene, slanderous, vulgar, or offensive. If profanity is used in content The Perfect Arm LLC, reserves the right to remove and or cancel the affiliate from the Kinetic Arm affiliate program.

12. Non-Disparagement.
Affiliate agrees to not directly or indirectly, make, publish, or communicate in any public from any defamatory or disparaging remarks, comments, or statements concerning the company or it's businesses, or any its employees, officers, shareholders, members, advisors, or any member of the Board. If situation arises The Perfect Arm LLC, (Kinetic Arm) reserves the right to cancel affiliate and handle accordingly.
11. Customer Service
Kinetic Arm will be responsible for handling website inquiries, product orders, shipment, customer billing and collection. Pricing of our products is totally withinits discretion and we as the owners reserve the right to change the pricing structure, terminate any special offers, change or discontinue products, at any time without advanced notice to affiliates or users accessing the site.
By agreeing to these terms of becoming a Kinetic Arm affiliate you are agreeing that you have read and understand the terms and conditions of this agreement and that you agree to be legally responsible for every term and condition. By using affiliate codes or links you agree to abide by these terms and conditions in addition to any terms set forth by the affiliate providing the code.
