These terms and conditions apply to both merchants ("we" or "merchant") and affiliates ("you" or "affiliate") participating in the Program. By participating, you agree to these Terms and Conditions. If you do not agree, you are not authorized to register as an Affiliate or participate in the Program.

1. Registration Approval: We reserve the right to approve or reject any Affiliate Program Registration at our discretion. You have no legal recourse for rejection.

2. Affiliate Links and Coupons: Affiliate links are automatically generated, but you can create links for specific products. Your link takes precedence if someone clicks multiple referral links. Coupons may or may not be assigned, and their usage is clarified on the Dashboard. Promoting the coupon is only allowed if assigned.

3. Commissions and Payments: You earn commissions based on the order value, excluding extra fees. Specify payment details in Settings. Payment schedule will be provided in the Affiliate Guide. Only completed transactions are eligible for payment. Chargebacks or refunds will not be paid out.

4. Marketing Tools: We provide promotional media through the Marketing tool tab for you to share on affiliate channels.

5. Network: If the Network tab is activated, you can invite others to become downline affiliates. Upline affiliates receive network commissions from downline affiliate orders based on merchant settings.

6. Cookies: We use cookies to track clicks on your link. If a person disables or clears cookies, we cannot track their activity or pay earnings. The tracking period starts from the customer's click or coupon use.

7. Removal from Referral Program: To be removed from the program, contact us at contact@topofthegalaxy.com.

UpPromote is the controller of any personal information provided to or collected by UpPromote under this Privacy Notice.

Information collected from Merchants:

When merchants use the app, we automatically access certain information from your Shopify account, such as email, first name, last name, and shop details (shop domain, currency, address, etc.). We collect this information to provide you with our services, including confirming your identity, contacting you, offering customer support, and conducting advertising and marketing activities.

Information collected from Affiliates:

When an Affiliate signs up to join a program, we collect information such as email, personal details, payment information, and social network information. This information helps merchants evaluate affiliate background and potential, facilitate specific activities within the app, and contact affiliates if needed.

Information collected from Customers when visiting merchant website:

To track referral orders, our UpPromote system collects information about customer orders when they visit the merchant website, including total order value, order items, and order ID.

About Cookies:

"Cookies" are data files that are placed on your device or computer and typically include an anonymous unique identifier. They are created when a user's browser loads a website, allowing the browser to store and send information to the website's server. We recommend keeping cookies enabled to benefit from essential features of the Affiliate marketing system.

Information sharing:

We prioritize your privacy and do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who assist with specific functions like email marketing, data analysis, and marketing support. These providers only access personal information as necessary to perform their functions and must adhere to this Privacy Policy. Use of UpPromote app by Children:

UpPromote is not intended for children. If you are under 13, you may only use the affiliate marketing system with the supervision of your parent or guardian.

If you are an affiliate, please contact the merchant directly to exercise these rights, as we act as a processor on their behalf.
