Welcome to Tyler's Trinkets NY! Thanks for your interest in our Affiliate program.

These following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to use product or service from the merchant.

By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Program in any manner.

1. Approve or Reject of the Registration

We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

2. Affiliate Links and Coupon

An affiliate link is automatically generated when your account is approved. You can also generate custom affiliate links for specific products or collections from within your account.

If a customer both clicks on the affiliate link and uses the affiliate coupon code, you will not receive a double commission.

Affiliate links and codes may be shared and used by any customers, including affiliates. Affiliates may advertise their code and the merchant website on online channels such as Facebook, Instagram, YouTube, TikTok, etc.

Your code should only be promoted on content you have made yourself, or that has been provided/shared by Tyler's Trinkets. Using other people's pictures/videos, without their permission, to promote your affiliate code can result in removal from the program and forfeit of any unpaid commissions. Promoting your code to other people's pictures/videos/posts that were not created by you, with the exception of directly answering a customer's question/comment on someone else's content, is prohibited.  

Affiliate codes and links may not be posted to, or shared on, bulk discount sites/groups (such as Honey, RetailMeNot, etc.) and doing so will result in removal from the program and forfeit of any unpaid commissions.

3. Commissions and payment

You will be eligible for a commission of 10% of the sale when a referred customer completes a purchase using your assigned affiliate link or coupon code. Commission amounts are determined by the order subtotal value, not including taxes, fees, or shipping.

In order to receive commission payouts, you must have valid payment details specified in the Settings under your account. Commissions will be reviewed and paid out according to the defined schedule.

Commissions payments will only be sent for transactions that have been successfully completed. Use of the Affiliate Program is subject to a fair use policy which gives merchant the right to review each and every referral order. The status of commission review is displayed on the Commission tab, and any paid commissions will be listed on Payment tab. Transactions that result in charge backs or refunds will not be eligible for commission and will not be paid out.

4. Marketing tools

We may share promotional media such as banners, logos or specific collection promotions to you through "Marketing Tool" tab. You are welcome and encouraged to use any promotional media made available to you. You are free to modify promotional media to add your affiliate code under the following circumstances:

1. Modifications must not block or inhibit view of any business logos and product images. This includes creating watermarks or placing text over logos.
2. If you include your affiliate code on a provided promotional graphic, you must include, either in the graphic or the post caption, the disclaimer that this is an affiliate code and you may receive commissions from sales made using the code.

5. Cookies

We use a web cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.

If a person doesn't allow cookies or clears their cookies after clicking your link and before completing their purchase, then we may be unable to track them and therefore be unable to pay commissions on their transaction.

7. Removal from Referral Program

If an affiliate wishes to be removed from the affiliate program, they can do so by contacting: tylerstrinketsny@gmail.com.

By joining the Affiliate program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support,... Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote app by Children

UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through tylerstrinketsny@gmail.com. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
