WILD WHOLISTIC AFFILIATE PROGRAM TERMS AND CONDITIONS
ABOUT WILD WHOLISTIC
Wild Wholistic is a therapeutic-grade herbal supplement brand built on formulation integrity, full transparency, and zero compromise on ingredients. We pioneered organic coconut glycerin as a base when the rest of the industry was using seed oil-derived glycerins. Every formula is dual extracted, third-party tested at the ingredient and batch level, and made without fillers or synthetic additives.
Our affiliate program is built on genuine community. We work with people who have felt the difference our products make and want to share that honestly with their audience.
AGREEMENT AND ACCEPTANCE
1.1 This Affiliate Program Agreement ("Agreement") governs your participation in the Wild Wholistic Affiliate Program ("Program"). By applying to, being accepted into, or continuing to participate in the Program, you ("Affiliate") agree to be bound by all terms set forth here.
1.2 Wild Wholistic Inc. ("Company") reserves the right to update or modify this Agreement at any time. Continued participation following any modification constitutes acceptance of the revised terms.
1.3 The Company reserves the right to accept or reject any application at its sole discretion.
PROGRAM OVERVIEW
2.1 Upon acceptance, Affiliate will receive a unique affiliate link and discount code to share with their audience.
2.2 Affiliate will earn commission on qualifying purchases made through their unique affiliate link. Commission rates are detailed in the Affiliate's account dashboard and are subject to change at the Company's discretion.
2.3 Affiliates may receive early access to new product releases and promotions at the Company's discretion.
COMMISSION AND PAYMENT
3.1 Attribution. The Program operates on a last-click attribution model. Cookie duration and attribution window details are specified in the Affiliate's account dashboard.
3.2 Qualifying Sales. Commission is earned on completed, non-refunded purchases made through the Affiliate's unique link within the applicable attribution window.
3.3 Refunds and Chargebacks. If a sale on which commission has been earned is subsequently refunded or charged back, the corresponding commission will not be paid or will be deducted from future payments.
3.4 Payment Schedule. Commissions are paid monthly on the 15th of each month for the prior month's qualifying sales. Payment requires current and complete payment information on file. The Company processes payments via the payment methods specified in the affiliate dashboard.
3.5 Minimum Payout. The Company reserves the right to establish a minimum commission threshold below which payment will be held until the threshold is reached.
3.6 Commission Modifications. The Company reserves the right to modify commission rates, payment schedules, and attribution models at any time. Affiliates will be notified of material changes through their account or by email.
ACTIVITY REQUIREMENTS
4.1 Affiliate participation type is designated at approval and noted in the Affiliate's account: Community Affiliate or Ambassador Affiliate.
4.2 Community Affiliates are expected to share content at least once per calendar month that visibly and clearly tags @wild.wholistic — meaning the tag must be legible, unobscured, and reasonably discoverable to anyone viewing the content (not hidden behind other tags, cropped out, added only after a post's peak visibility, or otherwise obscured). Community Affiliates who do not meet this requirement for two consecutive months may be placed in inactive status or removed from the Program at the Company's discretion.
4.3 Ambassador Affiliates are expected to generate qualifying sales or produce visible brand content that visibly and clearly tags @wild.wholistic, as described in Section 4.2, within any consecutive three-month period. Ambassador Affiliates who do not meet this requirement may be placed in inactive status or removed from the Program at the Company's discretion.
4.4 The Company reserves the right to determine, at its discretion, whether a tag meets the visibility standard described above.
4.5 Deactivated affiliates, regardless of type, forfeit access to their affiliate link and any unpaid commissions below the minimum payout threshold.
CONTENT STANDARDS AND COMPLIANCE
5.1 All content created by Affiliate in connection with the Program must comply with applicable FTC guidelines, FDA regulations governing supplement advertising, and all other applicable laws.
5.2 Affiliate is solely responsible for complying with all applicable FTC disclosure requirements governing affiliate and commission-based relationships. Wild Wholistic does not direct or control the specific format of such disclosures but requires that Affiliate comply with all applicable laws governing material connection disclosures in any content featuring Wild Wholistic products through which Affiliate may earn commission.
5.3 Affiliate shall not make any medical claims, disease claims, guaranteed outcome claims, diagnostic statements, or pharmaceutical comparison claims in connection with Wild Wholistic products. This includes claims that any product cures, treats, heals, reverses, or prevents any disease or medical condition.
5.4 All content must reflect Affiliate's genuine personal experience with Wild Wholistic products.
5.5 The Company reserves the right to request removal or modification of any content that does not comply with these standards. Affiliate must comply with such requests promptly.
5.6 Wild Wholistic's Compliance Guidelines provided to Affiliates upon acceptance are incorporated into this Agreement by reference.
CONTENT USAGE RIGHTS
6.1 By participating in the Program and creating content featuring Wild Wholistic products, Affiliate grants Wild Wholistic Inc. a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, edit, modify, adapt, publish, display, distribute, and create derivative works from any such content in any format and through any channel, including but not limited to social media platforms, paid advertising, website and digital platforms, email and SMS marketing, print and offline advertising, and any other commercial or non-commercial purpose at the Company's discretion.
6.2 This license is granted without any obligation to compensate, credit, notify, or seek approval from Affiliate except as required by applicable law.
6.3 Affiliate waives any moral rights in any content covered by this license to the fullest extent permitted by applicable law.
6.4 Affiliate represents and warrants that any content they create featuring Wild Wholistic products is original, does not infringe any third-party rights, and that Affiliate has full authority to grant the license described in this Section.
AFFILIATE CODE AND LINK USAGE
7.1 Affiliate's unique link and discount code are for personal use and distribution to their genuine audience only.
7.2 Affiliate shall not post their code or link on coupon websites, deal aggregator sites, or browser extension platforms without prior written consent from the Company.
7.3 Affiliate shall not use their own affiliate link to purchase products for themselves or people they know personally in order to generate commission.
7.4 Affiliate shall not artificially inflate clicks, referrals, or sales through any means including bots, fraudulent transactions, or self-referral schemes.
7.5 The Company monitors for unauthorized use of affiliate codes and links. Upon discovery the Company may issue a new code, suspend commission payments, or terminate participation.
PROHIBITED PRACTICES
Affiliate shall not:
8.1 Use Wild Wholistic's trademarks in paid advertising without prior written approval.
8.2 Bid on Wild Wholistic-branded keywords in any search engine advertising platform.
8.3 Engage in any misleading or deceptive marketing practices in connection with Wild Wholistic products.
8.4 Promote Wild Wholistic products alongside directly competing supplement brands in the same piece of content.
8.5 Make claims about Wild Wholistic products that are not supported by the Company's published materials or compliance guidelines.
8.6 Represent themselves as an employee, agent, or official spokesperson of Wild Wholistic without express written authorization.
8.7 Use Wild Wholistic's name, logo, or brand assets in any manner that misrepresents or damages the Company.
8.8 Engage in any public or private conduct, including but not limited to social media posts, public statements, reviews, or associations, that could reasonably damage, disparage, or misrepresent Wild Wholistic, its founders, its products, or its brand reputation. This obligation applies during participation in the Program and for twenty-four months following termination.
INTELLECTUAL PROPERTY
9.1 All Wild Wholistic trademarks, logos, product names, and brand assets are the sole and exclusive property of Wild Wholistic Inc.
9.2 Affiliate is granted a limited, non-exclusive, revocable license to use Wild Wholistic's brand assets solely for promoting Wild Wholistic products in accordance with this Agreement. This license terminates immediately upon termination of participation.
9.3 Affiliate shall not alter, modify, or misrepresent Wild Wholistic's brand assets or product claims in any content.
9.4 Wild Wholistic's product formulations, extraction methods, delivery systems, and proprietary frameworks constitute protected intellectual property. Affiliate shall not replicate, reverse engineer, or commercially utilize this proprietary knowledge.
COMPETITIVE PRODUCTS AND BRAND CONDUCT
10.1 Affiliate shall not feature or promote Wild Wholistic products alongside directly competing herbal supplement brands in the same piece of content. Outside of content featuring Wild Wholistic, Affiliate is free to work with other brands at their discretion.
10.2 Affiliate shall not publicly claim, imply, or represent that they have created, improved, replicated, or derived any product inspired by or based on Wild Wholistic's formulations, blends, or proprietary systems, whether during or after participation in the Program.
10.3 Affiliate shall not use Wild Wholistic's product names, formulation concepts, or brand positioning as a reference point for marketing any competing or similar product at any time.
CONFIDENTIALITY
11.1 Affiliate agrees to keep confidential any non-public information about Wild Wholistic's products, strategies, commission structures, and business operations received through participation in the Program.
11.2 Affiliate shall not disclose, share, or use such information for any purpose other than participating in the Program.
11.3 This obligation survives termination of this Agreement.
TERMINATION
12.1 The Company may terminate Affiliate's participation at any time, with or without cause, with or without notice.
12.2 Affiliate may withdraw from the Program at any time by providing written notice to the Company.
12.3 Upon termination, Affiliate's link and code will be deactivated immediately. Commissions above the minimum payout threshold for completed qualifying sales prior to termination will be paid on the next scheduled payment date, subject to deductions for refunds or chargebacks.
12.4 The Company may terminate immediately and forfeit all unpaid commissions in the event of material breach, fraudulent activity, non-compliant content, or conduct that harms Wild Wholistic's brand or reputation.
REPRESENTATIONS AND WARRANTIES
13.1 Affiliate represents and warrants that participation in the Program does not violate any other agreement to which Affiliate is a party, all content will be truthful and based on genuine personal experience, and Affiliate will comply with all applicable laws and platform terms of service.
LIMITATION OF LIABILITY
14.1 The Company shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to this Agreement or the Program.
14.2 The Company's total liability to Affiliate shall not exceed the total commissions paid to Affiliate in the three months preceding the claim.
INDEMNIFICATION
15.1 Affiliate shall indemnify and hold harmless Wild Wholistic Inc. and its founders, officers, and agents from any claims, damages, costs, and expenses arising from Affiliate's breach of this Agreement, non-compliant content, or violation of any applicable law.
GOVERNING LAW AND DISPUTE RESOLUTION
16.1 This Agreement shall be governed by the laws of the State of Wyoming without regard to conflict of law principles.
16.2 The Parties agree to attempt to resolve any dispute through good-faith negotiation before pursuing legal remedies.
16.3 If negotiation fails, disputes shall be resolved through binding arbitration in Cheyenne, Wyoming, under the rules of the American Arbitration Association.
GENERAL PROVISIONS
17.1 Entire Agreement. This Agreement constitutes the entire agreement between the Parties regarding the Program.
17.2 Severability. If any provision is found unenforceable the remaining provisions continue in full force.
17.3 Waiver. Failure to enforce any provision shall not constitute a waiver of future enforcement.
17.4 No Agency. Affiliate is an independent promoter and not an employee, agent, or representative of Wild Wholistic. Affiliate has no authority to bind the Company.
17.5 Notices. All notices shall be sent to affiliate@wildwholistic.com for the Company and to the email address on file in the Affiliate's account.
